KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS )
That, HALDEC, INC. , a Texas Corporation, GRANTOR, of the County
of Brazos , State of Texas, for and in consideration of the pay-
ment of TEN and NO/100 DOLLARS, and other good and valuable con-
sideration, in hand paid to GRANTOR by the CITY OF COLLEGE STA-
TION, TEXAS, the receipt of which is hereby acknowledged , has
GRANTED, SOLD and CONVEYED and by these presents does GRANT,
SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas
Municipal Corporation, certain rights and interests in the nature
of a perpetual EASEMENT on and through the following described
property:
All that certain tract or parcel of land lying
and being situated in the Morgan Rector League
in College Station, Brazos County, Texas,
being a part of that 300 acre tract conveyed to
Haldec , Inc . , by deed recorded in Volume 394 ,
Page 766 , of the Deed Records of Brazos County,
Texas;
provided, however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course , width, and cen-
terline on the attached Exhibit "A" , known as the "Easement
Area" .
To erect, construct, install , and thereafter use, operate, in-
spect, repair, maintain, reconstruct, modify, and remove the un-
derground electric distribution lines; upon, over, and across
said property as herein described and any ways , streets , roads ,
or alleys abutting same; and to cut, trim and control the growth
of trees and other vegetation on and in the easement area or on
adjoining property of GRANTOR, which might interfere with or
threaten the operation and maintenance of any public utility
equipment, accessories, or operations. It is understood and
agreed that any and all equipment and facilities placed upon said
property shall remain the property of GRANTEE.
GRANTOR expressly subordinates all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and shall provide lender' s subordinations on behalf
of GRANTEE.
GRANTOR and GRANTEE further covenant and agree that GRANTOR shall
be allowed to utilize the surface of the easement area for
greenspace , parking lots and driveways.
GRANTEE covenants and agrees that GRANTORS shall be allowed to
use the surface of the easement area for greenspace , parking
lots, and driveways.
It is expressly understood that the GRANTOR or future Owners of
this property reserves the right to use this EASEMENT for all
purposes which do not interfere with or prevent its use by the
GRANTEE.
TO HAVE AND TO HOLD the rights and interests herein described - t'
unto the CITY OF COLLEGE STATION, TEXAS, and its successor
assigns, forever, and GRANTOR does hereby bind itself, itsand /

singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming , or to claim same , or any
part thereof.

21 November 1989
All that certain tract or parcel of land lying and being situated
in the Morgan Rector League in College Station, Brazos County,
Texas, being a part of that 300 acre tract conveyed to Haldec,
Inc. by deed recorded in Volume 394 , Page 766 of the Deed Records
of Brazos County, Texas, and being an easement twenty feet (20 ' )
in width lying ten feet (10 ' ) each side of the following de-
scribed centerline:
Beginning in the southwest line of that 4. 489 acre tract conveyed
to the City of College Station by deed recorded in Volume 303 ,
Page 239 of the Deed Records of Brazos County, Texas, S 48 ° 02 '
35" E - 19. 75 feet from the most westerly corner of same.
Thence S 48 ° 03 ' 57" W - 255. 17 feet through the said Haldec,
Inc. tract to end of this easement in the centerline of that
fifty foot easement granted to the City of College Station by
Haldec, Inc. and described in Volume 823 , Page 543 of the Offi-
cial Records of Brazos County, Texas, at a point located S 39 °
28 ' 56" E 495. 3 feet from the intersection of the centerline of
said fifty foot easement and the fenceline along the northwest
line of the said Haldec, Inc. tract.
