TEMPORARY CONSTRUCTION EASEMENT

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS )
THAT, RANDALL L. COOPER and wife, PATRICIA C. COOPER, GRANTORS,
of the County of Brazos, State of Texas, for and in consideration
of the payment of TEN and NO/100 DOLLARS, and other good and val-
uable consideration, in hand paid to GRANTORS by the CITY OF COL-
LEGE STATION, TEXAS, the receipt of which is hereby acknowledged,
have GRANTED, SOLD and CONVEYED and by these presents do GRANT,
SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas
Municipal Corporation, certain rights and interests in the nature
of a Temporary Construction Easement on and through the following
described property:
Being a part of Lot 9, Block 3 of the
Dobrovolny Subdivision of the City of College
Station, Texas, as recorded in Volume 318,
Page 227 of the Deed Records of Brazos County,
Texas; more particularly described in the at-
tached Exhibit "A" .
Provided, however , that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and cen-
terline on the attached Exhibit "A" , known as the "Construction
Area" , which area is necessary to construct, install and attach
structures and equipment incident to the uses of the permanent
utility easement.
It is understood and agreed that any and all equipment and facil-
ities placed upon said property shall remain the property of
GRANTEE.
It is further understood and agreed that the temporary construc-
tion easement shall exist from the date construction begins on
this project until completion of the sanitary sewer project .
It is also agreed that the expiration of this construction ease-
ment shall not affect the GRANTEE ' S right to utilize the perman-
ent easement area previously described as being located as set
out in Volume 318, Page 227.
GRANTORS expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and agrees to lender ' s subordinations on behalf of
GRANTEE upon request.
GRANTEE expressly agree to return the construction easement area
to its original condition, or as close thereto as is reasonably
possible.
It is expressly understood that the GRANTORS or future Owners of
this property reserve the right to use this construction easement
for all purposes which do not interfere with or prevent its use
by the GRANTEE.

TO HAVE AND TO HOLD the rights and interests herein described un-
to the CITY OF COLLEGE STATION, TEXAS, and its successors and as-
signs, forever , and GRANTORS do hereby bind themselves, their
heirs and assigns, to warrant and forever defend, all and singu-
lar , these rights and interests unto the CITY OF COLLEGE STATION,
TEXAS, and its successors and assigns, against every person whom-
soever lawfully claiming, or to claim same, or any part thereof.

EXHIBIT A
SEWER LATERAL CONSTRUCTION
EASEMENT
Lot 9 , Block 3
Dobrovolny Subdivision
The Owner of Lot 9, Block 3 of the' Dobrovolny Subdivision
of the City of College Station, Texas, as recorded in
Voluem 318, Page 227 of the Deed Records of Brazos County,
Texas, grants to the City of College Station a one (1)
•
year construction easement 10-feet wide for the extension
of said lot's sewer service lateral to a proposed 16"
sewer line just south of said Lot 9.
Commencing at the southeast corner of said Lot 9, Thence
N 45° 12' W 50 feet, more or less, to a point in the
southwestern property line, said point also being the
POINT OF BEGINNING of said construction easement:
THENCE N 45° E. 17 feet, 'more or less, to a point in an
existing 6" sewer line, said point also being the general
location for the existing sewer lateral connection of
Lot 9, and the end of this Description, and containing
0.004 Ac of land, more or less.
