KNOW ALL MEN BY THESE PRESENTS :
COUNTY OF BRAZOS )
That, ST. THOMAS AQUINAS CATHOLIC CHURCH, GRANTOR, of the County
of Brazos, State of Texas, for and in consideration of the
payment of TEN and NO/100 DOLLARS, and other good and valuable
consideration, in hand paid to GRANTOR by the CITY OF COLLEGE
STATION, TEXAS , the receipt of which is hereby acknowledged, has
GRANTED , SOLD and CONVEYED and by these presents does GRANT,
SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas
Municipal Corporation, certain rights and interests in the nature
of a perpetual EASEMENT on and through the following described
property:
Being a 20 foot wide water line easement, lying
and being situated in the Morgan Rector Sur-
vey, Abstract No. 46 , College Station, Brazos
County, Texas, and being part of Lot 1 ( 10. 01
acres) Lord ' s Acres Subdivision, according to
the plat recorded in Volume 628 , Page 641 , of
the Official Records of Brazos County, Texas;
provided, however, that this conveyance shall
grant the rights
herein specified only as to that portion of the above described
property more
particularly described by course, width, and
centerline on the attached Exhibit "A" , known as the "Easement
Area" , and any additional area outside the Easement Area
necessary to install and attach equipment,
necessary and incident to the uses of the E asementeAred. anchors
To erect, construct, install ,
inspect, repair, maintain, reconstruct, modify, and operate,
following: remove the
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting
lines, access facilities, and related equipment;
Storm sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other
drainage structures, surface and subsurface;
upon, over, and across said property as herein described and an
ways, streets, roads, or alleys abutting same;
and control theand to cut, trim
growth of trees and other vegetation on and in
the easement area or on
adjoining of GRANTOR,
whichmight interfere with or threaten the maintenanceoperation and

placed upon said property shall remain the property of GRANTEE.

subordinates all rights of surface use incident
to the mineral estate to the above described uses of said

Field notes of a 20 foot wide water line easement, lying and being
situated in the Morgan Rector Survey, Abstract No. 46, College Station, Brazos
County, Texas, and being part of Lot 1 (10.01 acres) Lord's Acres Subdivision ,
according to the plat recorded in Volume 628, Page 641 , of the Official
Records of Brazos County, Texas , and said easement being 20 feet wide,
lying 10 feet on each side of the followingdescribed centerline :
COMMENCING at the 1/2" iron rod found marking the west corner of the
beforementioned Lot 1 , Lord' s Acres Subdivision, same being in the east
right-df-way line of State Highway No. 6, East By-pass,
from iron rod found marking the south corner of said Lot 1 bears Shic26r° 11 ' 43" E
473. 08 feet;
THENCE N 41 ° 23' 30" E along the northwest line of the beforementioned
Lot 1 , Lord's Acres Subdivision, for a distance of 449.86 feet to the
PLACE OF BEGINNING of this description, from which an existing water valve
bears N 44° 21 ' .38" W 5. 9 feet;
THENCE S 44° 21 ' 38" E for a distance of 201 .00 feet to the end of
this easement, from which the 5/8" iron rod found at a 6" creosote post
fence corner marking the east corner of the. beforementioned Lot 1 , Lord' s
Acres Subdivision bears N 67° 56' 36" E 529.96 feet.

STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or to claim same, or any
part thereof.
