That, SOUTH HIGHWAY 6 JOINT VENTURE, a Texas Joint Venture,
acting by and through its Managing Joint Venture Member, DAVID R.
BOLTON, of the County of Brazos, State of Texas, for and in
consideration of the payment of TEN AND NO/100 DOLLARS, and other good
and valuable consideration, in hand paid to GRANTOR by the CITY OF
COLLEGE STATION, TEXAS, the receipt of which is hereby acknowledged,
has GRANTED, SOLD and CONVEYED and by these presents does GRANT, SELL,
and CONVEY unto the said CITY OF COLLEGE STATION, a Texas Municipal
Corporation, certain rights and interests in the nature of a perpetual
EASEMENT on and through the following described property:
All that certain 0. 780 acre (33, 956 square feet) tract or parcel
of land, lying and being situated in the Robert Stevenson League,
Abstract No. 54, College Station, Brazos County, Texas, and being
a portion of Barron Park Subdivision, as shown by

It is expressly understood that the GRANTOR or future Owners of this
property reserve the right to use this EASEMENT for all purposes which
do not interfere with or prevent its use by the GRANTEE.
TO HAVE AND TO HOLD the rights and interests herein described unto the
CITY OF COLLEGE STATION, TEXAS, and its successors and assigns ,
forever, and GRANTOR does hereby bind itself, its successors and
assigns, to warrant and forever defend, all and singular, these rights
and interests unto the CITY OF COLLEGE STATION, TEXAS , and its
successors and assigns, against every person whomsoever lawfully
claiming, or to claim same, or any part thereof by through or under
him but not otherwise. Provided however, should Grantee, its
successors or assigns, cease to operate said pipelines on said
right-of-way, or should Grantee abandon the use and operation of said
pipelines upon, over or across the aforesaid property, andsuch
abandonment shall be for a continuous period of twelve (12) months,
then all rights, and the rights of use herein granted it thereupon
shall cease and be terminated, and any title held to such property by
the Grantee, Grantee ' s successors and assigns herein, shall
automatically revert back to the Grantor, Grantor ' s successors and
assigns.

Metes and bounds description of all the certain 0.780 acre (33,956
square feet) tract or parcel of land, lying and being situated in the Robert
Stevenson League, Abstract No. 54, College Station, Brazos County, Texas,
and being a portion of Barron Park Subdivision, as shown by plat recorded in
VOLUME 939, PAGE 209, of the Official Records of Brazos County, Texas and
being that same tract depicted as a 25' utility easement along the southwest
line of said subdivision, said 0.780 acre (33,956 square feet) tract being
more particularly described as follows:
BEGINNING at a 1/2" iron rod found marking the west corner of said
subdivision.
THENCE N 44° 40' 14" E for a distance of 25.00 feet with the northwest
line of said subdivision to a point for corner.
THENCE S 44° 34' 17" E for a distance of 635.10 feet with the northeast
line of said easement to a point for angle point.
THENCE S 46° 18' 32" E for a distance of 622.99 feet with said line to
a point for angle point.
THENCE S 46° 18' 06" E for a distance of 100.14 feet with said line to
a point in the southeast line of said subdivision.
THENCE S 44° 19' 33" W for a distance of 25.00 feet said subdivision
line to a 1/2" iron rod found marking the south corner of said subdivision.
THENCE N 46° 18' 06" W for a distance of 99.86 feet with the southwest
line of said subdivision to a 1/2" iron rod found for angle point.
THENCE N 46° 18' 32" W for a distance 623.37 feet with said line to a
1/2" iron rod found for angle point.
THENCE N 44° 34' 17" W for a distance of 635.15 feet with said line to
