THAT, F. M. ARNOLD AND OLIVE ARNOLD, GRANTORS of the County of
Brazos , State of Texas, for and in consideration of the payment
of TEN and NO/100 DOLLARS, cash, and other good and valuable
consideration, in hand paid to GRANTORS by the CITY OF COLLEGE
STATION, TEXAS, the receipt of which is hereby acknowledged ,
have GRANTED, SOLD and CONVEYED and by these presents do GRANT,
SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas
Municipal Corporation, certain rights and interests in the nature
of a perpetual EASEMENT on and through the following described
property:
Being a strip of land for a 30-foot wide
permanent public utility easement situ-
ated in the Robert Stevenson League,
Abstract No . 54, Brazos County, Texas,
out of a 50. 02 acre tract of land con-
veyed to F. M. Arnold, et ux, by deeds
recorded in Volume 189, Page 405 and
Volume 200, Page 445 of the Deed Records
of Brazos County, Texas, the boundary of
said easement being more fully described
as follows :
Provided, however , that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and cen-
terline on the attached Exhibit "A" ,

To erect, construct, install , and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the

Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting
lines, access facilities, and related equipment;
Storm sewers and collection facilities ;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other
drainage structures, surface and subsurface;
upon, over, and across said property as herein described and
ways , streets, roads, or alleys any
and control the growth of trees andothervegetation on and in
abutting same; and to cut, trim
the easement area or on adjoining property
might interfere with or threaten the maintenanceoperationGaandTORS, which
any public utility equipment, accessories, isof
understood and agreed that any and all equipmenteandlfacilities
placed upon said property shall remain the
property of GRANTEE.
GRANTORS expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface

to the CITY OF COLLEGE STATION, TEXAS, and its successors and
assigns, forever, and GRANTORS do hereby bind themselves, their
heirs and assigns , to warrant and forever defend , all and singu-
lar, these rights and interests unto the CITY OF COLLEGE STATION,
TEXAS, and its successors and assigns, against every person whom-
soever lawfully claiming, or to claim same, or any part thereof.

EXHIBIT A
UTILITY EASEMENT
F.M. ARNOLD TRACT
Being a strip of land for a 30-foot wide permanent public utility easement
situated in the Robert Stevenson League, Abstract No. 54, Brazos County,
Texas, out of a 50.02 acre tract of land conveyed to F.M. Arnold, et ux,
by deeds recorded in Volume 189, Page 405 and Volume 200, Page 445 of the
Deed Records of Brazos County, Texas, the boundary of said easement being
more fully described as follows:
BEGINNING at an iron rod found in the northwest right-of-way line of
Graham Road, said iron rod also being the most southerly corner of a 35.0
acre tract of land conveyed to the City of College Station by deed recorded
in Volume 676, Page 829 of the Deed Records of Brazos County, Texas; THENCE
S 41°55'31" W contiguous with the northwest right-of-way line of Graham Road
a distance of 379.0 feet, more or less, to an iron rod set for the most
southerly corner of said F.M. Arnold tract;
THENCE N 47°59'29" W contiguous with the southwest property line of said
F.M. Arnold tract a distance of 30.0 feet to a point for corner;
THENCE N 41°55'31" E 30.0 feet northwest and parallel to the northwest
right-of-way line of Graham Road a distance of 379.1 feet, more or less,
to a point for corner, said point also being on the common property line
of said F.M. Arnold and City of College Station tracts;
THENCE S 47°40'02" E contiguous with said common property line a distance
of 30.0 feet to the POINT OF BEGINNING and the end of this 30-foot easement
Description.
An additional easement for construction purposes is granted until completion
of a sanitary sewer and waterline project, said construction easement being
a strip of land 50 feet wide with the southeast boundary being contiguous
with the southeast boundary of the above described permanent utility easement.
