KNOW ALL ME BY THESE PRESENTS :
COUNTY OF WHARTON )
THAT, WILLIAM WAYNE ALLEN and wife, GELEE R. ALLEN, GRANTORS, of
the County of Wharton, State of Texas, for and in consideration
of the payment of TEN and NO/100 DOLLARS, cash, and other
good
and valuable consideration, in hand paid to GRANTORS by the CITY
OF COLLEGE STATION, TEXAS, the receipt of which is hereby ac-
knowledged, have GRANTED, SOLD and CONVEYED and by these presents
do GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE STATION,
a Texas Municipal Corporation, certain rights and interests in
the nature of a Temporary Construction Easement on and through
the following described property:
Being a strip of land in the J.E. Scott
League in College Station, Texas, twelve
and one-half ( 12. 5 ' ) feet in width
through Lot 2 in Block 3 of College Park,
an addition to the City of College Sta-
tion, Texas, according to plat of record
in Volume 38 , Page 602 of the Deed Re-
cords of Brazos County, Texas, being a
part of that tract conveyed to William
Wayne Allen and wife, Gelee R. Allen, by
deed recorded in Volume 260, Page 285 of
the Deed Records of Brazos County, Texas.
Provided, however, that this conveyance shall grant the rights
herein specified only as to that portion of the above-described
property more particularly described in Exhibit "A" ,
"Construction Area", which area is necessary to construct, in-
the
stall and attach structures and equipment incident to the uses of
the permanent utility easement.
It is further understood and agreed that the construc
ment shall exist for a period of onetion eaco-

struction begins on this ( ) year from the date con-
project.
It is also agreed that the expiration of this construction ease-
ment

ment shall not affect the GRANTEE 'S right to utilize the perma-
nent easement area. e
GRANTEE agrees that it will not disturb, harm, or damage
perma-
nent structures by its use of the easement area; a NTE
will not disturb unique landscaping such as large ftrees rand gar-
dens; however, GRANTEE shall have the right to require GRANTORS
to designate said unique landscaping gar-

GRANTEE expressly agrees to return the construction easement
to its original condition, or as close thereto as is
possible. area

It is expressly understood that the GRANTORS or future Owners of
this property reserve the right to use this Construction EASEMENT
for all purposes which do not interfere with or prevent its use
by the GRANTEE.
TO HAVE AND TO HOLD the rights and interests herein described un-
to the CITY OF COLLEGE STATION, TEXAS, and its successors and as-
signs, forever, and GRANTORS do hereby bind themselves, their
heirs and assigns, to warrant and forever defend, all and singu-
lar, these rights and interests unto the CITY OF COLLEGE STATION,
TEXAS, and its successors and assigns, against every person whom-
soever lawfully claiming, or to claim same, or any part thereof.
