THAT, JAMES P. WOODWORTH and wife, BETTIE L. WOODWORTH, GRANTORS,
of the County of Brazos, State of Texas, for and in consideration
of the payment of TEN and NO/100 DOLLARS, cash, and other good
and valuable consideration, in hand paid to GRANTORS by the CITY
OF COLLEGE STATION, TEXAS, the receipt of which is hereby ac-
knowledged, have GRANTED, SOLD and CONVEYED and by these presents
do GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE STATION,
a Texas Municipal Corporation, certain rights and interests in
the nature of a Temporary Construction Easement on and through
the following described property:
Being a strip of land in the J.E. Scott
League in College Station, Texas, twelve
and one-half ( 12.5 ' ) feet in width
through Lot 4 in Block 5 of College Park,
an addition to the City of College Sta-
tion, Texas, according to plat of record
in Volume 38 , Page 602 of the Deed Re-
cords of Brazos County, Texas, being a
part of that tract conveyed to James P .
Woodworth and wife, Bettie L. Woodworth,
by deed recorded in Volume 443 , Page 297
of the Deed Records of Brazos County,
Texas.
Provided, however, that this conveyance shall
herein specified only as to thatogrant the rights

Area", known as the "Construction
which area is necessary to construct, install and attach
structures and equipment incident to the uses of the
permanent
utility easement, said easement more fully depicted inthe

ities placed upon said property shall remain the

struction begins on this project. e
It is also agreed that the expiration of this construction ease-
ment shall not affect the GRANTEE 'S right to utilize the

nent easement area previously depicted in the attached Exhibitase-

It is expressly understood that the GRANTORS or future Owners of
this property reserve the right to use this Construction EASEMENT
for all purposes which do not interfere with or prevent its use
by the GRANTEE.
TO HAVE AND TO HOLD the rights and interests herein described un-
to the CITY OF COLLEGE STATION, TEXAS, and its successors and as-
signs, forever, and GRANTORS do hereby bind themselves, their
heirs and assigns, to warrant and forever defend, all and singu-
lar, these rights and interests unto the CITY OF COLLEGE STATION,
TEXAS, and its successors and assigns, against every person whom-
soever lawfully claiming, or to claim same, or any part thereof.
