KNOW ALL MEN BY THESE PRESENTS :
COUNTY OF BRAZOS )
THAT, ERIC JOHN SCHULTE and wife, LANETTE ROSE SCHULTE, GRANTORS,
of the County of Brazos, State of Texas, for and in consideration
of the payment of TEN and NO/100 DOLLARS, cash, and other good
and valuable consideration, in hand paid to GRANTORS by the CITY
OF COLLEGE STATION, TEXAS, the receipt of which is hereby
acknowledged, have GRANTED, SOLD and CONVEYED and by these
presents do GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE
STATION, a Texas Municipal Corporation, certain rights and
interests in the nature of a Temporary Construction EASEMENT on
and through the following described property:
Being a strip of land in the J.E. Scott League
in College Station, Texas, twelve and one-half
( 12. 5 ' ) feet in width through Lot 8 and Lot 9
in Block A of College Park, an addition to the
City of College Station, Texas, according to
plat of record in Volume 107, Page 151 of the
Deed Records of Brazos County, Texas, being a
part of that tract conveyed to Eric John
Schulte and wife, Lanette Rose Schulte, by
deed recorded in Volume 820 , Page 353 of the
Official Records of Brazos County, Texas.
Provided, however, that this conveyance shall
herein specified only as to that grant the rights
ove
property more particularly describedtbyncourse, we idth,dibeandreen-
terline on the attached Exhibit "A", known as the "Construction
Area", which area is necessary for the reconstruction and repair
of the sewerline located in the alley as set out in Volume 38 ,
Page 602, of the Deed Records of Brazos County, Texas.
It is understood and agreed that any and all equipment and facil-
ities placed upon said property shall remain the property of
GRANTEE.
It is further understood and agreed that the construction
ment shall exist for a period of one (1 ) eaco-
struction begins on this year from the date con-
project.
It is also agreed that the expiration of this construction ease-
ment shall not affect the Grantee's right to utilize the perman-
ent easement area previously described as being located in the
alley set out in Volume 38, Page 602.
GRANTEE agrees that it will not disturb, harm, or damage perma-
nent structures by its use of the easement area; further GRANTEE
will not disturb unique landscaping such as large trees and
gardens, however, GRANTEE shall have the right to require GRANTOR
to designate said unique landcaping prior to commencement of
construction.
GRANTORS expressly agree to return the construction easement are
to eighty (80%) percent of its original condition. a

It is expressly understood that the GRANTORS or future Owners of
this property reserves the right to use this Construction
EASEMENT for all purposes which do not interfere with or prevent
its use by the GRANTEE.
TO HAVE AND TO HOLD the rights and interests herein described un-
. to the CITY OF COLLEGE STATION, TEXAS, and its successors and as-
signs, forever, and GRANTORS do hereby bind themselves, their
heirs and assigns, to warrant and forever defend , all and singu-
lar, these rights and interests unto the CITY OF COLLEGE STATION,
TEXAS, and its successors and assigns, against every person whom-
soever lawfully claiming, or to claim same, or any part thereof.

Being a strip of land in the J . E . Scott League in College
Station, Texas, twelve and one-half (12.5 ' ) feet in width through
Lot 8 and Lot 9 in Block A of College Park, an addition to the
City of College Station, Texas, according to plat of record in
Volume 107, Page 151 of the Deed Records of Brazos County, Texas,
being a part of that tract conveyed to Eric John Schulte and
wife, Lanette Rose Schulte, by deed recorded in Volume 820, Page
353 of the Official Records of Brazos County, Texas, and being
more particularly described as follows :
Beginning in the southeast •line of Fidelity Street at the most
northerly corner of the said Schulte tract which is also the most
northerly -corner of Lot 9 of' Block A of the said College Park.
Thence S 41 ° 33 ' W - 12 . 5 feet along the southeast line of
Fidelity. Street
Thence S 47° 48' E - 100. Q feet through Lot 9• and Lot 8 to th
