KNOW ALL MEN BY THESE PRESENTS :
COUNTY OF BRAZOS )
THAT, LAURA M. HOLMES , GRANTOR, of the County of Brazos, State of
Texas, for and in consideration of the payment of TEN and NO/100
DOLLARS, cash, and other good and valuable consideration, in hand
paid to GRANTOR by the CITY OF COLLEGE STATION, TEXAS , the re-
ceipt of which is hereby acknowledged, has GRANTED, SOLD and CON-
VEYED and by these presents does GRANT, SELL, and CONVEY unto the
said CITY OF COLLEGE STATION, a Texas Municipal Corporation, cer-
tain rights and interests in the nature of a perpetual EASEMENT
on and through the following described property:
Being a strip of land 20 feet wide for a sanitary
sewer line easement situated in the Morgan Rector
League, Abstract No. 46, Brazos County, Texas, out
of a 15.0 acre tract of land conveyed to Ronald E.
Holmes and wife, Laura, by Deed recorded in Volume
617, Page 653 of the Deed Records of Brazos County,
Texas.
Provided, however, that this conveyance shall
grant the rights
herein specified only as to that portion of the above described
property more
particularlydescribed by course, width, and cen-
terline on the attached Exhibit "A" . Exhibit "A" shall be known
as the "Easement Area" , and any additional area outside the ease-
ment area necessary to install and attach equipment necessary and
incident to the uses of the Easement Area.
To erect, construct, install, and thereafter use, operate, in-
spect, repair, maintain, reconstruct, modify, and remove the fol-
lowing:
Sanitary sewer lines, connecting lines,
access facilities, and related equipment;
upon,
, over,
roads, alleys
as herein described and any
wad yy streets,
the abutting same; and to cut, trim
growth of trees and other vegetation on and in
the easement area or on adjoining property of GRANTOR,
might interfere with or threaten the operation and maintenah
any public utility equipment, accessories, or operations. Ites

placed upon said
property shall remain the property of GRANTEE.
GRANTOR expressly subordinates all rights of surface use
to the mineral estate to the above described uses of said

STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or to claim same, or any
part thereof.

UTILITY EASEMENT
RONALD E. HOLMES TRACT
Being a strip of land 20 feet wide for a sanitary sewer line easement
situated in the Morgan Rector League, Abstract No. 46, Brazos County,
Texas, out of a 15.0 acre tract of land conveyed to Ronald E. Holmes
and wife Laura by deed recorded in Volume 617, Page 653 of the Deed
Records of Brazos County, Texas; The centerline of said 20-foot
easement being more fully described as follows:
Commencing at the south corner of a 10.0 acre tract of land conveyed
to Frank J. Matous, Jr. and wife Helen by Victoria Kapchinski as
recorded in Volume 261, Page 629 of the Deed Records of Brazos County,
Texas; Thence in a northwesterly direction a distance of 18.6 feet, more
or less, to a point, said point also being the POINT OF BEGINNING of an
existing sanitary sewer line easement conveyed to the City of College
Station, Texas, by Victoria Kapchinski as recorded in Volume 335, Page
461 of the Deed Records of Brazos County, Texas; Thence S 42°49 ' W
541.5 feet, more or less, across the following properties to an angle
point;
1. A 3.0 acre tract of land conveyed to Henry Kapchinski
and wife Joyce by Victoria Kapchinski as recorded in
Volume 332, Page 41 of the Deed Records of Brazos
County, Texas;
2. The remaining protion of a 12.91 acre tract of land
conveyed to Henry Kapchinski and wife Joyce in
Volume 343, Page 284 of the Deed Records of Brazos
County, Texas;
3. A 15.0 acre tract of land conveyed to Ronald E. Holmes
and wife Laura by Henry Kapchinski and wife Joyce as
recorded in Volume 617, Page 653 of the Deed Records
of Brazos County, Texas;
Said angle point being situated in the above said 15.0 acre tra
also being the POINT OF BEGINNING of this Description; ct and
