CULPEPPER, JR. , GRANTOR, Individually and as heir of the Estate of J. C. CULPEPPER and MARY LAKE CULPEPPER, (herein referred to as "Grantor" ) , of the County of Brazos, State of Texas, for and in consideration of the sum of TEN and NO/100 DOLLARS ($10 . 00 ) in hand paid by the GRANTEE herein named , the receipt of which is hereby acknowledged, hereby QUITCLAIMS, GIVES and DONATES the property hereinafter described to the CITY OF COLLEGE STATION as a charitable contribution, which contribution is made in lieu of condemnation, and by these presents does QUITCLAIM, GIVE AND DONATE unto the CITY OF COLLEGE STATION, a Texas Municipal Home Rule Corporation, of the County of Brazos, State of Texas, (herein referred to as "Grantee" ) all of his right, title and interest in and to the following described real property situated in Brazos County, Texas, to-wit: All of that certain 0. 511 acre tract or parcel of land lying and being situated in the Richard Carter Survey, Abstract 8 , College Station, Brazos County, Texas, and being part of a 200 acre tract as de- scribed by deed from Mrs. Minnie Dansby, et al . , to College Hills Company, recorded in Volume 101 , Page 511 , of the Deed Records of Brazos County, Texas. Said 0. 511 acre tract being more particularly de- scribed as follows : BEGINNING at a 5/8 inch iron rod set for the north corner of Lot 1 of Woodland Estates as shown on plat of said Woodland Estates recorded in Volume 108 , Page 223 , of the Deed Records of Brazos County, Texas; THENCE S 41 °54 ' 56" W along the northwest line of said Lot 1 , at 578 . 02 feet past an iron rod found marking the north corner of a tract of land being part of said Lot 1 as described by deed recorded in Volume 472, Page 779, of the Deed Records of Brazos County, Texas, continue on for a total distance of 1130 . 16 feet to a point in the northeast line of Woodland Acres as shown on plat of said Woodland Acres, re- corded in Volume 104, Page 322, of the Deed Records of Brazos County, Texas; THENCE N 49°38 ' 19" W along said northeast line for a distance of 19 . 33 feet to a point being the north corner of said Woodland Acres, saidn� in the northwest line of said 200 acrelnt tractso lying P -. / 61X S54 PAGE 244 b P 4 THENCE N 41 °52 ' 37 " E along the northwest line of said 200 acre tract for a distance of 1130. 11 feet to a point being the north corner of said 200 acre tract, said point also lying in a southwest line of tract No. 1 of Carter' s Grove Second Installment Addition as shown on plat of said addition recorded in Volume 228 , Page 161 , of the Deed Records of Brazos County, Texas; THENCE S 49° 42 '57 " E along said southwest line, for a distance of 20. 09 feet to the PLACE OF BEGINNING and containing 22 ,268 square feet of land more or less. SAVE and EXCEPT GRANTOR, reserves all oil , gas and other minerals. GRANTOR hereby reserve unto himself, his successors and assigns, any and all oil , gas and other minerals in, on or under the premises described above; provid- ed that there shall never in any event be any ingress or egress on or across the surface of the above described premises for the purposes of exploration, development, production or transportation of such oil , gas or other minerals, it being expressly con- templated by the parties to this instrument that any production of such minerals shall be from the surface of other adjacent property and that there shall be no development of any minerals that would require min- ing, shaft mining, pit mining or any other kind of mining that would require utilization of the surface, or through the pooling of such mineral interests for the development with adjacent parcels and provided further that CULPEPPER does not reserve and expressly conveys to CITY any and all minerals of whatsoever kind and nature down to the depth of two hundred fifty (250 ) feet from the actual surface of any por- tion of said tract. TO HAVE AND TO HOLD all of his right, title and interest in and to the above-described property and premises unto the said GRANTEE, its successors and assigns forever, so that neither him nor his heirs, legal representatives or assigns shall have, claim or demand any right or title to the aforesaid property, premises, or appurtenances or any part thereof.
