COUNTY OF BRAZOS )
THAT, LAMBERT H. WILKES and wife, STELLA H. WILKES, GRANTORS , of
the County of Brazos, State of Texas, for and in consideration of
the payment of TEN and NO/100 DOLLARS, cash, and other good and
valuable consideration, in hand paid to GRANTORS by the CITY OF
COLLEGE STATION, TEXAS , the receipt of which is hereby acknowl-
edged, have GRANTED, SOLD and CONVEYED and by these presents do
GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a
Texas Municipal Corporation, certain rights and interests in the
nature of a Temporary Construction Easement on and through the
following described property:
Being a strip of land in the J.E. Scott
League in College Station, Texas, twelve
and one-half ( 12.5 ' ) feet in width
through Lot 10 and Lot 11 in Block A of
College Park, an addition to the City of
College Station, Texas, according to
plat of record in Volume 107 , Page 151
of the Deed Records of Brazos County,
Texas, being a part of that tract
conveyed to Lambert H. Wilkes and wife,
Stella H. Wilkes, by deed recorded in
Volume 361 , Page 261 of the Deed Records
of Brazos County, Texas.
Provided, however, that this conveyance shall
grant
herein specified only as to that portion of theabove-descrribed
property more particularly described by course, width, and cen-
terline on the attached Exhibit "A" ,

Area" , which area is necessary to construct, install oand rattach
structures, equipment, guy wires, and anchors necessary and inci-
dent to the uses of the permanent utility easement, said easement
more fully depicted in the attached Exhibit "B".
It is understood and agreed that any and all equipment and facil-
ities placed upon said property shall remain the property of
GRANTEE.
It is further understood and agreed that the construction ease-
ment shall exist for a period of one ( 1 ) year from the date con-
struction begins on this project.
It is also agreed that the expiration of this construction ease-
ment shall not affect the Grantee ' s right to utilize the perman-
ent easement area previously depicted in the attached Exhibit
"B" .
GRANTORS expressly subordinate all rights of surface use incident
to the mineral estate to the above-described uses of said surface
by GRANTEE, and agrees to sublender' s subordinations on behalf of
GRANTEE upon request.
GRANTORS expressly agree to return the construction easement area
to eighty ( 80%) percent of its original condition.
It is expressly understood that the GRANTORS or future Owners of
this property reserve the right to use this Construction EASEMENT
for all purposes which do not interfere with or prevent its use
by the GRANTEE.

TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its successors and
assigns, forever, and GRANTORS do hereby bind themselves, their
heirs and assigns, to warrant and forever defend , all and singu-
lar, these rights and interests unto the CITY OF COLLEGE STATION ,
TEXAS, and its successors and assigns, against every person whom-
soever lawfully claiming, or to claim same, or any part thereof.
