COUNTY OF BRAZOS )
THAT the undersigned, of the County of Brazos and State
of Texas, the present legal and equitable owner and holder of
that one certain promissory note in the original principal sum of
$1, 030, 000. 00, dated August 23, 1982, executed by J. A. C.
DEVELOPERS, INC. , to SAM SHARP, Trustee, payable to the order of
ROBERT F. SPEARMAN, more fully described in a Deed of Trust, duly
recorded in Volume 338, Page 97, of the Deed Records of Brazos
County, Texas ; said note being secured by said Deed of Trust
against, AMONG OTHER PROPERTY, the property as described on
Exhibit "A" attached hereto which is incorporated herein for all
purposes .
For a good and valuable consideration paid to the un-
dersigned, the receipt and sufficiency of which is hereby ac-
knowledged , the undersigned hereby EXPRESSLY SUBORDINATES the
above-described lien to the easement and right-of-way heretofore
or contemporaneously granted to the City of College Station by a
document executed by J. A. C. DEVELOPERS, INC. , and recorded in
the Deed Records of Brazos County, Texas .
It is expressly agreed and understood that this SUB-
ORDINATION shall in no wise release, affect or impair said lien
or liens against any other property or owner of any interest
therein, nor shall the priority of said lien or liens be affecte
except as to the City of College Station. d

J.A.C. DEVELOPERS, INC. TRACT
Being a strip of land 20.0 foot wide for a permanent public utility
easement in the S.W. Robertson Survey, Abstract No. 202, Brazos County,
Texas, out of a 51.83 acre tract, same tract being the remaining portion
out of the original 530.00 acre tract described as Tract No. 1 in the
deed for 478.18 acres from J.A.C. Developers, Inc., to W.D. Fitch dated
July 13, 1984 and recorded in Volume 703, Page 8 of the Deed Records of
Brazos County, Texas;
COMMENCING at an iron rod marking the most southerly corner of said
530.00 acre tract, said iron rod being located in a fence marking the
northeast right-of-way line of State Highway No. 6;
THENCE N 37°50'37" W along the northeasterly right-of-way line of State
Highway No. 6 a distance of 5.0 feet to a point, said point being the
PLACE OF BEGINNING for this easement description;
THENCE continue N 37°50'37" W along said northeasterly right-of-way line
of State Highway No. 6 a distance of 20.00 feet to a point for corner;
THENCE N 52°09'23" E a distance of 130.00 feet to a point for corner;
THENCE S 37°50'37" E a distance of 20.00 feet to a point for corner;
THENCE S 52°09'23" W a distance of 130.00 feet to a point in the
northeasterly right-of-way line of State Highway No. 6, same point being
the PLACE OF BEGINNING, and containing 0.0597 acres of land, more or less.
