SUBORDINATION OF LIEN

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS )
THAT the undersigned, of the County of Brazos and State
of Texas, the present legal and equitable owner and holder of
that one certain promissory note in the original principal sum of
$292 , 500 .00 , dated October 30 , 1978 , executed by F. W. "BERT"
WHEELER to IOLA BARRON WILCOX, TRUSTEE, payable to the order of
FRAULINE PUTZ SIMS and husband , J. W. SIMS, more fully described
in a Deed of Trust, duly recorded in Volume 247 , Page 472 of the
Deed Records of Brazos County, Texas ; said note being secured by
said Deed of Trust against, AMONG OTHER PROPERTY, the property as
described on Exhibit "A" attached hereto which is incorporated
herein for all purposes .
For a good and valuable consideration paid to the un-
dersigned, the receipt and sufficiency of which is hereby ac-
knowledged , the undersigned hereby EXPRESSLY SUBORDINATES the
above-described lien to the easement and right-of-way heretofore
or contemporaneously granted to the City of College Station by a
document executed by F. W. "BERT" WHEELER to IOLA -BARRON WILCOX,
Trustee, and recorded in the Deed Records of Brazos County,
Texas.
It is expressly agreed and understood that this SUB-
ORDINATION shall in no wise release , affect or impair said lien
or liens against any other property or owner of any interest
therein, nor shall the priority of said lien or liens be affected
except as to the City of College Station.

Metes and bounds description of all that certain 1 . 007 acre tract or
parcel of land lying and being situated in the Richard Carter
Survey, Abstract 8 , College Station, Texas , and being part of a
13 . 727 acre tract as described by deed from Frauline Putz Sims , et
vir, to F.W. "Bert" Wheeler, recorded in volume 444 , page 800 of the
Deed Records of Brazos County, Texas . Said 1 . 007 acre tract being
more particularly described by metes and bounds as follows :
BEGINNING at a 5/8 inch iron rod found marking the south corner of
said 13 .727 acre tract, said iron rod also marking the east corner
of a 7 . 39 acre tract as described by deed recorded in volume 583 ,
page 298 of the Deed Records of Brazos County, Texas ;
THENCE N 48°59 ' 39" W along a common line of said 13 . 727 acre tract
and said 7 . 39 acre tract for a distance of 23 . 80 feet to a 5/8 inch
iron rod set for corner;
THENCE through said 13 . 727 acre tract for the following calls:
N 41 °54 ' 56" E for a distance of 114 . 45 feet to a 5/8 inch
iron rod set for the beginning of a curve to the left being
concave to the northwest and having a radius of 656 . 00
feet;
Northeasterly along said curve for an arc length of 721 . 28
feet to a 5/8 inch iron rod marking the end of this curve,
the chord bears N 10°48 ' 36" E for a distance of 677 . 80
feet;
N 20°17 ' 45" W for a distance of 17 . 37 feet to a 5/8 inch
iron rod set for the beginning of a curve to the left being
concave to the southwest and having a radius of 25 . 00 feet;
Northwesterly along said curve for an arc length of 39 . 28

way line of University Drive (FM 60 ) ,
