THAT, M.H.B.R. JOINT VENTURE, a Texas General Partnership,
GRANTOR, of the County of Brazos, State of Texas, for and in con-
sideration of the payment of TEN and NO/100 DOLLARS, cash, and
other good and valuable consideration, in hand paid to GRANTOR by
the CITY OF COLLEGE STATION, TEXAS, the receipt of which is here-
by acknowledged , has GRANTED, SOLD and CONVEYED and by these
presents does GRANT, SELL, and CONVEY unto the said CITY OF
COLLEGE STATION, a Texas Municipal Corporation, certain rights
and interests in the nature of a perpetual EASEMENT on and
through the following described property:
Lots 4 and 5, Block D, Ashford Square Subdivision,
College Station, Texas, platted and recorded in
Volume 590, Page 269, of the Deed Records of Brazos
County, Texas.
Provided, however, that this conveyance shall

centerline on the attached Exhibit "A" , known as the "Easement

GRANTOR expressly subordinates all rights of surface use incident
to the mineral estate to the above described uses of said surface

Being a 20' wide strip of land for the purpose of a drainage ease-
ment and being part of Lots 4 and 5, Block D, Ashford Square
Subdivision, platted and recorded in Volume 590, Page 269, Deed
Records, Brazos County, Texas and its center line being more
properly described as follows:
Commencing at the northernmost corner of Lot 5, Block D, Ashford
Square Subdivision ;
THENCE N 44°37' 14" E for a di stance of 2.00' to the POINT OF
BEGINNING;
THENCE S 45°8'29" E for a distance of 154.50' ;
THENCE N 45°8'29" W for a distance of 10.00' ;
THENCE N 44°32'3" E for a distance of 34.00' to the end of said
easement .
