SUBORDINATION OF LIEN

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS )
THAT the undersigned , of the County of Tarrant and
State of Texas, the present legal and equitable owner and holder
of that one certain promissory note in the original principal sum
of $91 ,723. 18, dated October 21 , 1977, executed by Jose E.
Montemayor, payable to the order of THE PATTON CORPORATION, more
fully described in a Deed of Trust, duly recorded in Volume 226,
Page 378, of the Deed Records of Brazos County, Texas; said note
being secured by said Deed of Trust against, AMONG OTHER
PROPERTY, a twenty foot (20 ' ) wide strip of land along the
northeast property line, described on Exhibit "A" attached hereto
which is incorporated herein for all purposes, for TEN DOLLARS
($10.00 ) and certain other good and valuable considerations,
receipt for which is hereby acknowledged , does hereby bind THE
PATTON CORPORATION, its successors or assigns, to Warrant forever
unto the CITY OF COLLEGE STATION that Warrantor shall in no wise
interfere with or oppose any lawful access by Warrantee to the
easement and right-of-way heretofore granted to the City of
College Station by a document executed by Jose C. Montemayor, and
recorded in the Deed Records of Brazos County, Texas.

JOSE C. MONTEMAYOR TRACT
Being a strip of land 20-foot wide for a permanent public utility
easement situated in the Maria Kegans League, Abstract No. 28,
Brazos County, Texas, of a 1.707 acre tract conveyed to Jose C.
Montemayor by deed recorded in Volume 354, Page 33 of the Deed
Records of Brazos County, Texas. Th-e centerline of said 20-foot
easement being more fully described as follows:
Beginning at an iron pin for the most easterly corner of said
Montemayor tract said point also being the most northerly
of a 0.7 acre tract conveyed to Peter D. Williamson by deed
recorded in Volume 569, Page 61 of the Deed Records of Brazos
County, Texas; Thence southwest 10 feet, more or less, along the
southeast property line of said Montemayor tract to the POINT OF
BEGINNING;
