FEDORA, of the Count of razo,, State of Texas, and JUDY FEDORA, of the County ofe Co State of GRANTORS, for and in consideration of the ents of TEN and NO/100 DOLLARS , cash, and other good and valu- able ableconsideration, in hand paid to GRANTORS by the CITY OF COLLEGE STATION, TEXAS, and WELLBORN WATER SUPPLY CORPORATION, the receipt of which is hereby acknowledged, have GRANTED, SOLD and CONVEYED and by these presents do GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas Municipal Corpora- tion, and WELLBORN WATER SUPPLY CORPORATION, a Texas Corporation, certain rights and interests in the nature of a perpetual EASE- MENT on and through the following described property: A 1 .25 acre tract situated in the Robert Stevenson League, Abstract No. 54, conveyed to Herb L. Fedora and wife, Judy Fedora, by Deed recorded in Volume 227, Page 500 of the Deed Records of Brazos County, Texas. Provided, however, that this conveyance shall grant the rights herein specified only as to that portion of the above described property more particularly described by course, width, and cen- terline on the attached Exhibit "A" , known as the "Easement Area" , and any additional area outside the easement area neces- sary to install and attach equipment, guy wires, and anchors necessary and incident to the uses of the Easement Area. To erect, construct, install , and thereafter use, operate, inspect, repair, maintain, reconstruct, modify, and remove the following: Water lines and sanitary sewer lines, connecting lines, access facilities, and related equipment; upon, over, and across said property as herein described and any ways, streets, roads, or alleys abutting same; and to cut, trim growth of trees and other vegetation on and in the easement area or on adjoining property might interfere with or threaten the operationGandTORSmain, which tenance of any public utility equipment, accessories, or operations. It is understood and agreed that any and all equipment and facilities placed upon said property shall remain the property of GRANTEE. GRANTORS expressly subordinate all rights of surface use incident to the mineral estate to the above described uses of said surface by GRANTEE, and agree to sublender' s subordinations on behalf of GRANTEE upon request. It is expressly understood that the GRANTORS or future Owners of this property reserve the right to use this EASEMENT for all purposes which do not interfere with or prevent its use by the GRANTEE. FEDORA Being a strip of land 20 feet wide for a permanent utility easement situated in the Robert Stevenson League, Abstract No. 54, in Brazos County, Texas, being part of the remainder of a 1.25 acre tract conveyed to Herb L. Fedora and wife Judy Fedora by deed recorded in Volume 227, Page 500 of the Deed Records of Brazos County, Texas, and the centerline of said 20 foot easement being more fully described as follows: BEGIN at a point in the northeast right-of-way line of State Highway FM 2154 and the southerly right-of-way line of a county road called North Graham Road, said point also being the most westerly corner of the remaining portion of a 1.25 acre tract conveyed to Herb L. Fedora and wife Judy Fedora, as described above; Thence northeasterly along the southerly right-of-way line of above described North Graham Road, also being the northwesterly line of the Fedora tract, a distance of 10 feet to the point of beginning on the centerline of the 20 foot easement; THENCE S 43° E parallel with and 10 feet northeast of the northeast right-of-way line of FM 2154 a distance of 157 feet, more or less, to a point in the southeasterly line of the Fedora tract and the end of this easement; said point also being northeast 10 feet from an iron pin in the northeasterly right-of-way line of FM 2154, said point also being the most southerly corner of the Fedora tract.and the most westerly corner of the Wellborn Road, Ltd. 159.657 acre tract as recorded in Volume 636, Page 680. An additional easement for construction purposes is also granted across this tract for a period of time commencing with the date hereon and extending until the completion and acceptance by the City of College Station of a waterline to be constructed within sa per- manent utility wideanstrip easement, said construction easement being a 50foot of land with the southwesterly line of said construction easement being coincident with the northeasterly right-of-way of said Highway FM 2154, same being the southwesterly line of the Fedora tract and the 20 foot permanent utility easement. line
