KNOW ALL MEN BY THESE PRESENTS :
COUNTY OF BRAZOS )
THAT, KEITH COWAN and wife, JANEY LOUISE COWAN, GRANTORS, of the
County of Brazos, State of Texas, for and in consideration of the
payment of TEN and NO/100 DOLLARS, cash, and other good and
valuable consideration , in hand paid to GRANTORS by the CITY OF
COLLEGE STATION, TEXAS, the receipt of which is hereby
acknowledged , have GRANTED, SOLD and CONVEYED and by these
presents do GRANT, SELL, and CONVEY unto the said CITY OF COLLEGE
STATION, a Texas Municipal Corporation , certain rights and
interests in the nature of a perpetual EASEMENT on and through
the following described property:
Being a strip of land ten feet ( 10 ' ) wide situated in
the Crawford Burnett League in College Station , Brazos
County, Texas, being a part of Lot 39E, Block 14 of
the Southwood Section 25 , College Station , Texas, as
recorded in Volume 445 , Page 213 of the Deed Records
of Brazos County, Texas .
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A" , known as the "Easement
Area" , and any additional area outside the easement area

To erect, construct, install , and thereafter use , operate ,
inspect, repair, maintain, reconstruct, modify, and remove the
following:
Water lines and sanitary sewer lines, connecting
lines, access facilities, and related equipment;
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting
and control the growth of trees and othersamevegetatiionoonuandtinm
the easement area or on adjoining property of GRANTORS, which
might interfere with or threaten the operation and maintenance
any public utility equipment, accessories, or operations. of

understood and agreed that any and all equipment and facilitIt ies
placed upon said property shall remain the property of GRANTEE .
GRANTORS expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and agree to sublender' s subordinations on behalf of
GRANTEE upon request .
It is expressly understood that the GRANTORS or future
this property reserve the right to use this EASEMENT for all
of
purposes which do not interfere with or prevent its use by the
GRANTEE .

TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its successors and
assigns, forever , and GRANTOR does hereby bind itself, its
successors, and assigns, to warrant and forever defend , all and
singular , 'these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming , or to claim same , or any
part thereof .

LOT 39E, BLOCK 14
SOUTHWOOD SECTION 25
Being a strip of land 10 feet wide for a water transmission line easement
situated in the Crawford Burnett League in College Station, Brazos County,
Texas, being a part of Lot 39E, Block 14 of the Southwood Section 25, College
Station, Texas, as recorded in Volume 445, Page 213 of the Deed Records of
Brazos County, Texas, the centerline of said 10 foot wide easement being more
fully described as follows:
BEGIN at a FM 2818 right-of-way monument in the south corner of Lot 39, Block
14 of said Section 25; Thence N 46° 22' 47" E, a distance of 239.30 feet
along a common line between said Lot 39 and the northwest right-of-way line of
• FM 2818 to a point; Thence N 43° 37' 11" W a distance of 19.58 feet along a
common property line between said Lot 39E and Lot 39D, Block 14 of said
Section 25; to the POINT OF BEGINNING of this description;
THENCE N 45° 29' 55" E, a distance of 84.78 feet to a point; said point being
located on the common property line between said Lot 39E and Lot 39G, Block
14, of said Section 25, and also being located 20.89 feet from the northwest
right-of-way line of FM 2818 along said common property line; said point being
the end of this 10 foot wide water transmission line easement.
An additional easement for construction purposes is granted for a period of
one (1) year from the date hereon, said construction easement being a 30 foot
wide strip of land and the centerline of said construction easement
corresponding to the centerline of said water transmission line easement.
