HomeMy WebLinkAbout1984V691P11 30 100`, UTILITY EASEMENT , (Specific Property) STATE OF TEXAS ' KNOW ALL MEN BY THESE PRESENTS : COUNTY OF BRAZOS THAT, JEFF PARKER, TRUSTEE, GRANTOR, of the County of Brazos, State of Texas, for and in consideration of the payment of TEN AND NO/100 DOLLARS, cash, and other good and valuable consideration, in hand paid to GRANTOR by the City of College Station, Texas, the receipt of which is hereby acknowledged, HAS GRANTED, SOLD, AND CONVEYED and by these presents does GRANT, SELL, and CONVEY unto the said City of College Station, a Texas Municipal Corporation certain rights and interests in the nature of a perpetual EASEMENT on and through the following described property: Being part of a 8. 97 acre tract situated in the Morgan Rector League, Abstract No. 46, Brazos Count conveyed to Jeff Parker, Trustee bydeed recorded in Volum, 526, Page 609 of the Deed Records ofBrazosCounTexas . y,T Provided however, that this conveyance shall grant the rights herein specified only as to that portion of the above described property more particularly described by course, width, and centerline on the attached Exhibit "A" known as the "Easement Area" , and any additional area outside the easement area necessary to install and attach all equipment and facilities necessary and incident to the uses of the Easement Area . To erect, construct, install, and thereafter use, operate, inspect, repair, maintain, reconstruct, modify, and remove the we / . Water lines and sanitary sewer lines, connecting lines, access facilities, and related equipment upon, over, and across said property as herein described and any ways, streets, roads, or alleys abutting same; and to cut, trim and control the growth of trees and other vegetation on and in the easement area or on adjoining property of Grantor, which might interfere with or threaten the operation and maintenance of any public utility equipment, accessories, or operations . It is understood and agreed that any and all equipment and facilities placed upon said property shall remain the property of Grantee. Grantor expressly subordinates all rights of surface use incident to the mineral estate to the above described uses of said surface by Grantee, and agree to sublender' s subordinations on behalf of Grantee upon request. It is expressly understood that the Grantor or future Owners of this property reserve the right to use this EASEMENT for all purposes which do not interfere with or prevent its use by the Grantee . TO HAVE AND TO HOLD the rights and interests herein described unto the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns forever, and GRANTOR DOES hereby bind himself, his heirs and assigns to warrant and forever defend, all and singular, these rights and interests unto the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns, against every person whomsoever lawfully claiming, or to claim same, or any part thereof. TREMONT Being a strip of land 30 feet wide for a sanitary sewer line easement situated in the Williams-Winder King Subdivision, Brazos County, Texas, and being part of that tract of land conveyed to Jeff Parker by deed recorded in Volume 526, Page 609, Brazos County, Texas Deed Records, the said 30 foot easement being more fully described by metes and bounds as follows: BEGINNING at an iron pin found in the northerly right-of-way line of Krenek Tap Road (a 40 foot street) , said point also being the south corner of said Parker tract of land and the east corner of a tract of land conveyed to Allen R. Swoboda by deed of trust recorded in Volume 274, Page 338, Brazos County, Texas Deed Records: THENCE N 44°57'51" W, along the common property line between the Parker tract of land and the Swoboda tract of land, a distance of 752.73 feet to an iron pin found for the west corner of said Parker tract and the north corner of said Swoboda tract, said iron pin also being in the southeasterly line of a tract of land conveyed to John Ben Carrabba by deed recorded in Volume 470, Page 334, Brazos County, Texas Deed Records; THENCE N 44°38'39" E, along the common line between the Parker tract of land and the Carrabba tract of land a distance of 30.0 feet to a point; THENCE S 44°57'51" E, along and parallel to the common property line between the Parker tract of land and the Swoboda tract of land a distance of 752.92 feet to a point in the northerly right-of-way line of said Krenek Tap Road; THENCE S 45°00'49" W, along the northerly right-of-way line of said Krenek Tap Road a distance of 30.0 feet to the POINT OF BEGINNING and containing 0.518 acres (22,584.73 square feet) of land, more or less; An additional easement for construction purposes is granted for a period of one (1) year from the date hereon, said construction easement being a 75 foot wide strip of land, the centerline of said construction easement being 37.50 feet northerly from and parallel with the southerly line of said Jeff Parker tract of land. pyfT u rr�- .11 +� -.c_Y_Fr,., 14 I;
