KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS
THAT, CARRARA PARTNERSHIP, of the County of Brazos, State of
Texas, GRANTOR, for and in consideration of the payment of TEN
AND NO/100 DOLLARS, cash, and other good and valuable
consideration, in hand paid to GRANTOR by the CITY OF COLLEGE
STATION, TEXAS, the receipt of which is hereby acknowledgedO, HAS
GRANTED, SOLD, and CONVEYED and by these presents does GRANT,
SELL, and CONVEY unto the said CITY OF COLLEGE STATION, a Texas
Municipal Corporation, certain rights and interests in the nature
of a perpetual EASEMENT on and through the following described
property:
Being a strip of land forty feet (40 ' ) wide for a
construction easement situated in the J.W. Scott
League, Abstract No. 49, and the Richard Carter League,
Abstract No. 8, in Brazos County, Texas, and being out
of a 250.0 acre tract conveyed to Texas Instruments,
Inc. , by deed recorded in Volume 424, Page 78, of the
Deed Records of Brazos County, Texas, said strip of
land being contiguous to, and the southeast line of
said construction easement being coincident with, the
southeast line of said 250 .0 acre tract, said line
being the northwest line of State Highway 30, said
construction easement being granted for one (1 ) year
from the date hereon.
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by
centerline on the attached Exhibit "A" course, width, and
Area", and any additional area outsidenown theaseasementSement area
necessary to install and attach all equipment and facilities,
including guy lines and anchors, necessary and incident to the
uses of the Easement Area.
To erect, construct, install, and thereafter
inspect, repair, maintain, reconstruct, and, operate,v
following: modify, and remove the
Water lines and sanitary sewer lines, connecting
lines, access facilities, and related equipment
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same'; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of GRANTOR,
might interfere with or threaten the operation and mnttenancelof
any public utility equipment, accessories, or operations . It is
understood and agreed that any and all equipment and facilities
placed upon said property shall remain the property of GRANTEE.
GRANTOR expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by GRANTEE, and agree to sublender ' s subordinations on behalf of
GRANTEE upon request.
It is expressly understood that the GRANTOR or future Owners of

assigns forever, and GRANTOR does hereby bind itself, and its
successors and assigns, to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or to claim same, or any
part thereof.

EXHIBIT A
THE CARRARA PARTNERSHIP TRACT
Being a strip of land 20-foot wide for a permanent public utility
easement situated in the J.W. Scott League, Abstract No. 49,
Brazos County, Texas, and being out of a 113.67 acre tract conveyed
to the Carrara Partnership by deed recorded in Volume 586, Page 488
of the Deed Records of Brazos County, Texas. The centerline of said
20-foot easement being more fully described as follows:
Begin at an iron pin in the northwest right-of-way line of State
Highway 30, said iron pin also being the most southerly corner of
said Carrara Partnership tract; thence in a northwesterly direction
along the most southwesterly property line of said Carrara Partner-
ship tract 10 feet to the POINT OF BEGINNING;
THENCE northeast parallel with and 10 feet northwest of the north-
west right-of-way line of State Highway 30 for the following calls:
N 48°00'49" E 1939.7 feet to a point;
N 50°44'01" E 1110.1 feet to a point on the common property line of
said Carrara Partnership tract and a 3.0 acre tract conveyed to
Leonard McDonald by deed recorded in Volume- 161, Page 268 of the Deed
Records of Brazos County, Texas; said point being the end of this
easement; said point also being 11 feet, more or less, west of an
iron pin on the northwest right-of-way line of State Highway 30.
An additional easement for construction purposes is granted for
one (1) year from the date hereon, said construction easement being
a 40-foot wide strip of land whose southeasterly boundary is coinci-
dent with the southeasterly boundary of the said Carrara Partnership
tract and the aforesaid 20-foot permanent utility easement.
