THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS
THAT, BRAZOSLAND PROPERTIES, INC. , a Texas corporation, of
the County of Brazos, State of Texas, for and in consideration of
the payment of TEN AND NO/100 DOLLARS, cash, and other good and
valuable consideration, in hand paid to GRANTOR by the CITY OF
COLLEGE STATION, Texas, the receipt of which is hereby
acknowledged, HAVE GRANTED, SOLD, AND CONVEYED and by these
presents do GRANT, SELL, AND CONVEY unto the said CITY OF COLLEGE
STATION, a Texas Municipal Corporation certain rights and
interests in the nature of a perpetual EASEMENT on and through the
following described property:
Being a twenty (20') foot wide strip of land and a ten (10')
foot wide strip of land through that 21.96 acre tract in the
Robert Stevenson League in Brazos County, Texas, conveyed to
BRAZOSLAND PROPERTIES, INC. , by Deed recorded in Volume 615,
Page 287 of the Deed Records of Brazos County, Texas.
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property which is more particularly described by course, width,
and centerline on the attached Exhibits "A" & "B", known as the
"Easement Areas", together with the right to erect and maintain guy
anchors, poles, and wire spans, at certain and precise locations, all
shown on Exhibit "C" hereto attached as a plat of the Easement Areas.
The purpose of this easement being to grant to Grantee the
right to erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove single
pole electric transmission and distribution lines upon, over, and
across said property as herein described [as limited by Exhibit "C"] ;
and to cut, trim and control the growth of trees and other vegetation
on and in the Easement Area which might interfere with or threaten
the operation and maintenance of any public utility equipment,
accessories, or operations. It is understood and agreed that any and
all equipment and facilities placed upon said property shall remain the
property of Grantee.

Grantor expressly subordinates all rights of surface use incident
to the mineral estate to the above described uses of said surface by
Grantee. Grantee by this EASEMENT is granted no part of or interest in
the mineral estate in and to the property described herein.
It is expressly understood that the Grantor or future Owners of
this property reserve the right to use this EASEMENT for all purposes
which do not interfere with or prevent its use by the Grantee, for
the purpose herein stated including, but not limited to, parking areas,
driveways and/or access, landscaping and lawn areas.
Grantee agrees that at the request of Grantor, Pole No. 1 shown
on Exhibit "C" will be moved by Grantee, at its expense, in a Northwesterly
direction, within the Easement Area, approximately 37 feet.
It is understood and agreed that the Centerline of the Easement Area
is five (5) feet east of the proposed future western right-of-way line
of State Highway 6. That if the condemning authority has not acquired
property extending to the proposed right-of-way line of said highway
within two (2) years from the date hereof, Grantee, at its cost and
expense will, at the request of Grantor, remove within 90 days the poles,
lines and anchors from the Easement Area and this EASEMENT shall be null,
void and without effect.
TO HAVE AND TO HOLD the rights and interests herein described unto
the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns forever.
