KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS *
THAT, JOE A. FERRERI, GRANTOR, a married man, not joined
herein by his wife by virtue of the fact that the property hereby
conveyed is his sole and separate estate, of the County of
Brazos, State of Texas, for and in consideration of the payment
of TEN AND NO/100 DOLLARS, cash, and other good and valuable
consideration, in hand paid to GRANTOR by the City of College
Station, Texas, the receipt of which is hereby acknowledged,
HAS GRANTED, SOLD, AND CONVEYED and by these presents does GRANT,
SELL, and CONVEY unto the said City of College Station, a Texas
Municipal Corporation certain rights and interests in the nature
of an EASEMENT on and through the following described property:
Being a strip of land in a 54.99 acre tract situated in the
Thomas Caruthers League, Abstract No. 9 and the Robert
Stephenson League, Abstract No. 54, Brazos County, Texas,
conveyed to Joe A. Ferreri in Volume 292, Page 190 of the
Deed Records of Brazos County, Texas .
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A" , known as the "Easement
Area" , and any additional area outside the easement area
necessary to install and attach all equipment and facilities
necessary to maintain said easement.
To erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the
following:

Electric transmission and distribution lines
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of Grantor, which
might interfere with or threaten the operation and maintenance of
any public utility equipment, accessories, or operations . It is
understood and agreed that any and all equipment and facilities
placed upon said property shall remain the property of Grantee.
Grantor expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by Grantee.
It is expressly understood that the Grantor or future Owners of
this property reserve the right to use this 20 ' EASEMENT for all
purposes which do not interfere with and prevent its use by the
Grantee, including without limitation, the use and construction
of streets, roadways, driveways, alleys, parking lots, paving,
curbs, lawns, and other like uses, on, over, and across this
EASEMENT. Grantee shall replace and restore any damage done by
the Grantee to the above described items constructed or used by
the Grantor.
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and
assigns forever, and GRANTOR DOES hereby bind himself, his heirs
and assigns to warrant and forever defend, all and singular,
these rights and interests unto the CITY OF COLLEGE STATION,
TEXAS, and its successors and assigns, against every person
whomsoever lawfully claiming, or the claim same, or any part
thereof.

EXHIBIT "A"
Being a strip of land for a permanent utility easement situated in the Thomas
Caruthers League, Abstract No. 9 and the Robert Stephenson League, Abstract No.
54, Brazos County, Texas, in a 54.99 acre tract of land conveyed to
Joe A. Ferreri in Volume 292, Page 190 of the Deed Records of Brazos County,
Texas, and being more particularly described below:
The following is a centerline description of a twenty (20) foot wide
utility easement, said easement being measured ten (10) feet in width on each
side of the following described centerline:
Commencing at a point in the westerly property line of said tract of land and
the easterly right-of-way line of Rock Prairie Road, said point being located
5 feet more or less southwesterly from an iron rod set for the most northerly
corner of the property;
Thence along centerline S 66° E for a distance of 8 feet to a point of angle
in said easement;
Thence continuing along centerline N 89° E, approximately parallel to and
9.5 feet south of the northerly boundary line of said tract and southerly
right-of-way. line of Rock Prairie Road, for a distance of 1150 feet to the point
of ending of said easement located in the easterly property line of said
tract of land, said point located 9.5 feet from an iron rod set for an easterly
corner of said tract of property and in the southerly right-of-way line of Rock
Prairie Road.
