That I, Christopher C. Harness, General Partner of COLLEGE STATION BUSINESS PARK, LTD. ,
being the owner in fee simple of the hereinafter described property located in College
Station, Brazos County, Texas, do in consideration of the sum_ of .One Dollar ($1.00) to
me in hand paid by the City of College Station the receipt of which is hereby acknowledged,
grant, sell, transfer, release and forever quit-claim unto the said City of College Station,
its successors and assigns, an easement for utility purposes said easement being in, upon,
under, over, across and along the following described tract or parcel of land and being
more particularly described as follows:
Field note description of a 3,936.65 square foot (0.0904 Acre) tract of land out of Lot 2,
Block 12, Southwood - Section 26, College Station, Brazos County, Texas and being more
particularly described below:
COMMENCING at the Northeasterly corner of the aforementioned Lot 2, also being the
Southwesterly corner of Longmire Drive (70' R.O.W. ) and its intersection with F.M. 2818.
THENCE, N 43° 29' 55" W, along the southerly right-of-way line of Longmire Drive,
a distance of 10.00 feet to a point;
THENCE, S 46° 22' 47" W, a distance of 25.00 feet to a point, said point being on the
southerly line of an existing 25-foot utility easement which parallels the aforementioned
Longmire Drive, THE PLACE OF BEGINNING:
THENCE, continuing in a S 46° 22' 47" W direction , along the westerly line of an
existing 10-foot utility easement which parallels the aforementioned F.M. 2818, a distance
of 393.29 feet to a point for corner, said corner being the Southeasterly corner of the
herein described tract;
THENCE, N 45° 52' 48" W, a distance of 10.01 feet to a point for corner;
THENCE, N 46° 22' 47" E, a distance of 393.66 feet to a point for corner, said corner
being the Northwesterly corner of the herein described tract;
THENCE, S 43° 29' 55" E, a distance of 10.00 feet to a point, THE PLACE OF BEGINNING
and containing 3,936.65 square feet of land.
I do hereby agree, bind and obligate myself, my heirs or assigns, that no fences,
buildings or other improvements shall be placed in,' on or along said easement, and further,
that the City shall be and is hereby released and relieved from any and all liability from
any damages occasioned by and in the reasonable exercise of its rights granted herein or
hereunder.
TO HAVE AN TO HOLD the above described property and easement for said purposes,
together with all the rights and appurtenances thereto in anywise belonging to said City
of College Station, its successors and assigns forever. However, it is expressly provided,
that if said easement or any part thereof is ever discontinued for said purposes, the title
thereto (or to the part so discontinued) shall revert to the then owners of said property,
the right and privilege being reserved to the City of College Station, its successors,
assigns or agents, to go upon said premises at any time for the purpose of removing,
repairing or replacing any utility thereon or the eunder. �c

a distance of 185.75 feet to THE PLACE OF BEGINNING:
