KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS *
THAT, DAVID DRAPELA and wife, BETTY JEAN DRAPELA, GRANTORS,
of the County of Brazos, State of Texas, for and in consideration
of the payment of TEN AND NO/100 DOLLARS, cash, and other good
and valuable consideration, in hand paid to GRANTORS by the City
of College Station, Texas, the receipt of which is hereby
acknowledged,
HAVE GRANTED, SOLD, AND CONVEYED and by these presents do GRANT,
SELL, and CONVEY unto the said City of College Station, a Texas
Municipal Corporation certain rights and interests in the nature
of an EASEMENT on and through the following described property:
Being a part of Lot 4, Block 1 of the Pooh' s Park
Subdivision situated in the Morgan Rector Survey, Abstract
No. 46, to City of College Station as recorded in Volume
314, Page 618, of the Deed Records of Brazos County, Texas.
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A" , known as the "Easement
Area" , and any additional area outside the easement area
necessary to install and attach all equipment and facilities
necessary to maintain said easement.
To erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the
following:
Electric transmission and distribution lines

Water lines and sanitary sewer lines, connecting lines,
access facilities, and related equipment for the construction and
operation of a major "trunk line" sanitary sewer.
Storm sewers and collection facilities
Television, telephone, and communications lines
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on andin
the easement area or on adjoining property of Grantor, which
might interfere with or threaten the operation and maintenance of
any public utility equipment, accessories, or operations . It is
understood and agreed that any and all equipment and facilities
placed upon said property shall remain the property of Grantee.
Grantors expressly subordinate all rights of surface use incident
to the mineral estate to the above described uses of said surface
by Grantee.
It is expressly understood that the Grantors or future Owners of
this property reserve the right to use this 15 ' EASEMENT for all
purposes which do not interfere with and prevent its use by the
Grantee, including without limitation, the use and construction
of streets, roadways, driveways, alleys, parking lots, paving,
curbs, lawns, and other like uses, on, over, and across this
EASEMENT. Grantee shall replace and restore any damage done by
the Grantee to the above described items constructed or used by
the Grantors.
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and
assigns forever, and GRANTORS DO hereby bind themselves, theirs
heirs and assigns to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every

person whomsoever lawfully claiming, or the claim same, or any
part thereof.

Field notes of a 15 foot wide utility easement, lying and being situated
in the Morgan Rector Survey, Abstract No. 46, College Station, Brazos County,
Texas , and being a part of Lot 4, Block 1 , of the Pooh' s Park Subdivision to
the City of College Station, Texas , the plat of same being recorded in Volume
314, Page 618, of the Deed Records of Brazos County, Texas, said 15 foot wide
utility easement being 7.5 feet on each side of the following described
centerline:
BEGINNING at a point in the northwest line of the abovementioned Lot 4,
same being the southeast right-of-way line of Holleman Drive, said point also
being located S 41 ° 31 ' 31 " W 7. 50 feet from the north corner of said Lot 4;
THENCE S 48° 28' 29" E parallel with and 7.50 feet southwest from the
northeast line of Lot 4 for a distance of 299.95 feet to a point in the
southeast line of the said Lot 4 for the end of this 15 foot wide easement.
