KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS *
THAT, FOXFIRE DEVELOPMENT CORPORATION, GRANTOR, of the
County of Brazos, State of Texas, for and in consideration of the
payment of TEN AND NO/100 DOLLARS, cash, and other good and
valuable consideration, in hand paid to GRANTOR by the City of
College Station, Texas, the receipt of which is hereby
acknowledged,
HAS GRANTED, SOLD, AND CONVEYED and by these present does GRANT,
SELL, and CONVEY unto the said City of College Station, a Texas
Municipal Corporation certain rights and interests in the nature
of an EASEMENT on and through the following described property:
Being situated in the THOMAS CARUTHERS LEAGUE, Brazos
County, Texas, and being Lot 5, Block 7, of the Foxfire
Addition to Brazos County, Texas, recorded in Volume 358,
Page 291 of the Deed Records of Brazos County, Texas.
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A" , known as the "Easement
Area" .
To erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the
following:

upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of Grantor, which
might interfere with or threaten the operation and maintenance of

understood and agreed that any and all equipment and facilities
placed upon said property shall remain the property of Grantee .
All debris, brush, etc. shall be removed by Grantee and site
restored to original condition.
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and
assigns forever, and GRANTOR DOES hereby bind itself, its
successors and assigns to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or the claim same, or any
part thereof.

FOXFIRE ADDITION
Being a strip of land 20-feet wide for a sanitary sewer line easement
situated in the Morgan Rector League, Brazos County, Texas, being a
part of Lot 5, Block 7, of the Foxfire Addition to Brazos County,
Texas, recorded in Volume 358, Page 291 of the Deed Records of Brazos
County, Texas, the centerline of said 20-foot easement being more
fully described as follows:
BEGIN at an iron pin in the northwest corner of Lot 5, Block 7 of
said Foxfire Addition, said iron pin also being the northeast
corner of Lot 4, Block 7 of said Foxfire Addition; Thence south-
easterly 13.74 feet along a common line between said Lot 5 and the
south right-of-way line of Foxfire Drive to the POINT OF BEGINNING
of this DESCRIPTION;
THENCE S 2° 26' E 266.4 feet to a point in the common property line
between said Lot 5 and Lot 10, Block 7, of said Addition, except that
portion thereof lying west of an existing 10-foot public utility
easement, said point on the property line being easterly 6.3 feet
from an iron pin in the common corner of said Lots 4 and 5 of said
Addition, said point being the end of this 20-foot sanitary sewer
easement.
An additional easement for construction purposes is granted for a
period of one (1) year from the date hereon, said construction
easement being a 30-foot wide strip of land and the centerline of
said construction easement being more fully described as follows:
BEGIN at the POINT OF BEGINNING of the aforesaid centerline of
10-foot sanitary sewer line easement; Thence southeasterly 11 feet
along south right-of-way line of Foxfire Drive to the POINT OF
BEGINNING of this DESCRIPTION;
THENCE S 2° 26' E 266 feet along a line 11 feet east of and parallel
with centerline of said 20-foot sanitary sewer line easement to a
point in the common property line between Lot 10 and Lot 5, Block 7
of said Addition, said point on the property line being easterly
17.3 feet from an iron pin in the common corner of Lots 4 and 5 of
said Addition and the end of this 30-foot wide construction ease-
ment.
