KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS *
THAT, FRANK ELBRICH, SR. and wife, MARY M. ELBRICH, joining
herein pro forma, GRANTORS, of the County of Brazos, State of
Texas, for and in consideration of the payment of TEN AND NO/100
DOLLARS, cash, and other good and valuable consideration, in hand
paid to GRANTOR by the City of College Station, Texas, the
receipt of which is hereby acknowledged,
HAVE GRANTED, SOLD, AND CONVEYED and by these presents do GRANT,
SELL, and CONVEY unto the said City of College Station, a Texas
Municipal Corporation certain rights and interests in the nature
of an EASEMENT on and through the following described property:
Being situated in the Crawford Burnett League, Abstract 7,
in Brazos County, Texas and being a 50. 1 acre tract conveyed
to Frank Elbrich, SR. by deed recorded in Volume 201, Page
107 of the Deed Records of Brazos County, Texas .
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A" , known as the "Easement
Area" .
To erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the
following:
Water transmission and distribution lines, and rela d
facilities and equipment.

upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of Grantor, which
might interfere with or threaten the operation and maintenance of
any public utility equipment, accessories, or operations. It is
understood and agreed that any and all equipment and facilities
placed upon said property shall remain the property of Grantee.
TO HAVE AND TO HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and
assigns forever, and GRANTORS DO hereby bind themselves, their
heirs and assigns to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or the claim same, or any
part thereof.

FRANK ELBRICH, SR.
Being a strip of land 20 feet wide for a water transmission line easement
situated in the Crawford Burnett League, Abstract 7, in Brazos County, Texas,
being a part of a 50.1 acre tract conveyed to Frank Elbrich, Sr. , by deed
recorded in Volume 201, Page 107, of the Deed Records of Brazos County, Texas,
and the centerline of said 20-foot easement being more fully described as
follows:
BEGIN at a point in the south corner of a 1 acre tract conveyed to
John E. Elbrich by deed recorded in Volume 231, Page 649 of the Deed Records
of Brazos County, Texas, said point also being in the common property corner
between said 1 acre tract and the remaining portion of said 50.1 acre tract
and in the northeast right-of-way line of State Highway FM 2154; Thence
southeasterly 20 feet, more or less, along said northeast right-of-way line
of FM 2154 to the POINT OF BEGINNING of this DESCRIPTION;
THENCE N 87°58' E 14.14 feet to an angle point;
THENCE S 47°02' E 335. 1 feet parallel with and 10.0 feet northeast of
said right-of-way line of FM 2154 to a point on the common property line
between the remaining portion of said 50.1 acre tract and a 2.0 acre tract
conveyed to Carmelo F. Januse, Sr. and wife, Mary E. Januse by deed recorded
in Volume 276, Page 131 of the Deed Records of Brazos County, Texas said
point being northeast 10.0 feet along said common property line from the
westernmost corner of said 2.0 acre tract, said corner being in said right-
of-way line of FM 2154, said point also being the end of this 20-foot ease-
ment.
An additional easement for construction purposes is granted for a period of
one (1) year from the date hereon, said construction easement being a 50-foot
wide strip of land and the centerline of said construction easement following
parallel with and 15.0 feet northeast of the centerline of said 20-foot water
transmission line easement.
