Texas, for and in consideration of the payment of TEN AND NO/100
DOLLARS, cash, and other good and valuable consideration, in hand
paid to GRANTOR( s ) by the City of College Station, Texas, the
receipt of which is hereby acknowledged,
HAVE GRANTED, SOLD, AND CONVEYED and by these present do GRANT,
SELL, and CONVEY unto the said City of College Station, a Texas
Municipal Corporation certain rights and interests in the nature
of an EASEMENT on and through the following described property:
Being a 56 .42 acre tract in the Morgan Rector Survey more
particularly described in Vol . 40Alkiag ., ,of the Deed
Records, Brazos County, Texas .
Provided however, that this conveyance shall grant the rights
herein specified only as to that portion of the above described
property more particularly described by course, width, and
centerline on the attached Exhibit "A" , known as the "Easement
Area" , and any additional area outside the easement area
necessary to install and attach anchors and guy lines or wires.
To erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify, and remove the

upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim
and control the growth of trees and other vegetation on and in
the easement area or on adjoining property of Grantor, which
might interfere with or threaten the operation and maintenance of
any public utility equipment, accessories, or operations . It is
understood and agreed that any and all equipment, poles, and
facilities placed upon said property shall remain the property of
Grantee.
TO HAVE AND TO 'HOLD the rights and interests herein described
unto the CITY OF COLLEGE STATION, TEXAS, and its succesors and
assigns forever, and GRANTOR( s) DOES hereby hind themselves,
their heirs and assigns to warrant and forever defend, all and
singular, these rights and interests unto the CITY OF COLLEGE
STATION, TEXAS, and its successors and assigns, against every
person whomsoever lawfully claiming, or the claim same, or any
part thereof.

EXHIBIT "A"
Beginning at a point in the easterly property line of the
Kapchinski 56 .42 acre tract described in Vo1121, Page 6i of the
Deed Records of Brazos County, Texas, and the westerly right of
way line of the State Highway No. 6 East By-Pass said point
being located more or less southerly a distance of 9. 5 feet from
the most easterly corner of a 47 . 22 acre tract owned bythe City
of College Station for the location of Central Park, same being
described in Vol. -398, Page 383*of the Deed Records, of Brazos
County, Texas said corner also being the northeast corner of the
Kapchinski tract .
Thence along centerline South 36° West for a distance of 22 feet
to an angle point, said angle point located 10 feet inside a
northwesterly boundary of the Kapchinski property, the same being
the southeasterly property line of the aforementioned City of
College Station tract of land, for a distance of 1374 feet to an
angle point;
Thence continuing along centerline across said tract of land
South 39° 45 ' West for a distance of 402 feet to an angle point
and end of this easement. Said ending point being located in a
City of College Staiton easement recorded in •Vol. 511 , Page 263
of the Deed Records of Brazos County, Texas .
