FOJTIK and wife, ANNIE MARY FOJTIK GRANTOR(S) of the County of Harris , State of Texas for and in consideration of the payment of TEN AND NO/100 DOLLARS, cash, in hand paid to GRANTOR(S) by the City of College Station, Texas, the receipt of which is hereby acknowledged, HAVE GRANTED, SOLD, AND CONVEYED and by these present do GRANT, SELL, and CONVEY unto the said City of College Station, a Texas Municipal Corporation certain rights and interests in the nature of an EASEMENT on and through the following described property: Being a 48.74 acre tract of land lying and being situated in the Morgan Rector League Abstract 46, Brazos County, Texas, and being more particularly described in Vol . 246, page 657, of the Deed Records, Brazos County, Texas. Provided however, thatthis conveyance shall grant the rights herein specified only as to that portion of the above described property more particularly described by course, width, and centerline on the attached Exhibit "A" , known as the "Easement area" , and any additional area outside the easement area necessary to install and attach anchors and guy lines or wires. To erect, construct, install , and thereafter use, operate, inspect, repair, maintain, reconstruct, modify, and remove the following: X Electric transmission and distribution lines Sanitary sewer lines, connecting lines, and access facilities Storm sewers and collection facilities Television, telephone, and communications lines upon, over, and across said property as herein described and any ways, streets, roads, or alleys abutting same; and to cut, trim and control the growth of trees and other vegetation that might interfere with or threaten the operation and maintenance of any public utility equipment or accessories. 'ssion expires 03-17-84 - v ►Lc'( ct:'AGE 293 EXHIBIT "A" The following is a centerline description of arty (40) foot wide utility easement, said easement to be measured twenty (20) feet in width on each side of the following described centerline: BEGINNING at a point in the common property line of the 48.74 acre tract of land owned by C.A. Fojtik lying in the Morgan Rector [league and being more fully described in Vol . 246 page 657 of the Deed Records of Brazos County, Texas, and the 20.69 acre tract of land owned by Robert Martell , lying in the Morgan Rector League and being more fully described in Vol .334 page 340 of the Deed Records of Brazos County, Texas; said point being located northwesterly a distance of two (2) feet from the northerly corner of the Robert Martell tract. THENCE along a centerline bearing S 37°31 ' West for a distance of 2027 feet to the point of conclusion, said point located in the northeast boundary line of a 27.6 acre tract owned by F.S. Kapchinski , lying in the Morgan Rector League and being more fully described in Vol . 62 page 422 of the Deed Records of Brazos County, Texas, said point also located southeasterly a distance of 10.5 feet from the most westerly corner of the Kapchinski tract.
