UTILITY EASEMENT

STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF BRAZOS
THAT, HATTIE KAPCHIN.SKI , HENRY KAPCHINSKI , LOUIS KAPCHINSKI , ANNIE
KAPCHINSKI FOJTIK, HELEN KAPCHINSKI MATOUS, and CHRISTINE KAPCHINSKI
SECHELSKI
GRANTOR(S) of the County of RRA7fS _, State of TEXAS
for and in consideration of the payment of TEN AND NO/100 DOLLARS, cash,
in hand paid to GRANTOR(S)' by the City of College Station, Texas, the
receipt of which is hereby acknowledged,

HAVE GRANTED, SOLD, AND CONVEYED and by these present do GRANT, SELL,
and CONVEY unto the said City of College Station, a Texas Municipal
Corporation certain rights and interests in the nature of an EASEMENT
on and through the following described property:
Being a 27.6 acre tract of land in the Morgan Rector Survey. Same being
a part of that 85 acre tract described in Vol . 62 page 422 and a 56.42
acre tract in the Morgan Rector Survey more particularly described in Vol .
121 page 61 , of the Deed Records, Brazos County, Texas.
Provided however, thatthis conveyance shall grant the rights herein
specified only as to that portion of the above described property �.
more particularly described by course, width, and centerline on the
attached Exhibit "A" , known as the "Easement area" , and any additional
area outside the easement area necessary to install and attach anchors
and guy lines or wires.
To erect, construct, install , and thereafter use, operate, inspect,
repair, maintain, reconstruct, modify, and remove the following:
X Electric transmission and distribution lines
Sanitary sewer lines, connecting lines , and access facilities
Storm sewers and collection facilities
Television, telephone, and communications lines
upon, over, and across said property as herein described and any
ways, streets, roads, or alleys abutting same; and to cut, trim and
control the growth of trees and other vegetation that might interfere
with or threaten the operation and maintenance of any public utility
equipment or accessories. It is understood and agreed that any and all
equipment, poles, and facilities placed upon said property shall remain
the property of Grantee.

EXHIBIT "A"
The following is a centerline description of a forty (40) foot wide
utility easement, said easement to be measured twenty (20) feet in width
on each side of the following described centerline:
BEGINNING at a point in the northeast property line of a 27.6 acre tract
of land owned by F.S. Kapchinski , located in the Morgan Rector league and
being a part of that 85 acre tract described in Vol . 62 page 422 of the
Deed Records, Brazos County, Texas , said point also being in the southwest
property line of a 48.74 acre tract of land owned by C.A. Fojtik, located
in the Morgan Rector league and being more particularly described in Vol .
246, page 657 of the Deed Records, Brazos County, Texas, said point being
more or less southeasterly a distance of 10.5 feet from a northerly corner
of the property, the same being the most westerly corner of the aforementioned
C.A. Fojtik tract.
THENCE along centerline South 37° 30' West, varying from 10.5 feet to 0.5
feet inside a northwest boundary line of said tract, the same being the
a O! southeast property line of a 55.03 acre tract of land owned by the Westing-

/),b' house Corporation, for a distance of 907 feet to a point of exit from the
j � property in the easterly right-of-way line of the State Highway No. 6 East
9� Bypass, said point being located more or less southerly a distance of 0.5
feet from a corner of the property, the same being the most southerly corner

of the aforementioned Westinghouse Corporation, tract of land.
THENCE commencing again at a point in the westerly right-of-way line of the
State Highway No.6 East Bypass, and outside said property, said point being
located more or less northerly a distance of 6 feet from a corner of the
1/) property, said corner being the most easterly corner of a 47.22 acre tract
t� P owned by the City of College Station for the location of Central Park, same
5 being described in Vol . 398 page 383 of the Deed Records , of Brazos County,
Texas.
THENCE continuing again along centerline South 37°30' West, varying from
6.5 feet to 10.5 feet outside a northwesterly boundary of the property, the
same being the southeasterly property line of the aforementioned City of
College Station tract of land, for a distance of 1296 feet to a point in a
northeasterly boundary of said tract and the southwesterly boundary line of
the aforementioned City of College Station tract, said point located more
or less northwesterly a distance of 6 feet from the most southerly corner
of the above referenced City of College Station tract of property.
THENCE continuing along centerline across said tract of land being a 56.42
acre tract fully described in Vol . 121 page 61 of the Deed Records, Brazos
County, Texas. South 37°30' West for a distance of 1610 feet to an angle
point in said easement, said angle point located 2 feet more or less north-
westerly from a southeast boundary of the property.
THENCE continuing along centerline S 57° 30' W, parallel to and 2 feet more
or less northerly from a southeast boundary of the property, for a distance
of 279 feet to a point of exit in the westerly boundary line of this tract
of land and the northeast boundary line of a 20.24 acre tract of property
owned by the City of College Station, and being described in Vol . 363 page
62 of the Deed Records , Brazos County, Texas said exit point being located
more or less northwesterly a distance of 2 feet inside the most southerly
corner of said tract of land.
TO HAVE AND TO HOLD the rights and interests herein before described
unto the said City of College Station, Texas and its successors and assigns
forever and I do hereby bind myself, my heirs, executors and administrators,
to warrant and forever defend, all and singular these rights and interests
unto the said City of College Station, Texas, and its successors and assigns ,
against every person whomsoever lawfully claiming, or to claim the same, or
any part thereof.
