CASH DEED
KNOW ALL MEN BY THESE PRESENTS that I , DOROTHY BRANN
McCRORY, a feme sole, hereinafter referred to as "Grantor" , for
and in consideration of the sum of TEN AND NO/100 DOLLARS ( $10 . 00 )
and other good and valuable consideration to it paid by THE CITY
OF COLLEGE STATION, a Texas municipal corporation, acting herein
by its duly authorized officers, hereinafter referred to as
"Grantee" , as follows:
CASH IN HAND PAID, the receipt of which is hereb
acknowledged.
Have GRANTED, SOLD and CONVEYED, and by these present-
do GRANT, SELL and CONVEY, unto the said THE CITY OF COLLEG
STATION, County of Brazos, State of Texas, all that certain
Tract or parcel of land lying and being situated in the
Crawford Burnett League in College Station, Brazos County,
Texas, being a part of that 7 . 68 acre tract described in
Volume 271 , Page 259 of the Deed Records of Brazos County,
Texas, and a part of that 39. 98 acre tract described in
Volume 207, Page 621 of the Deed Records of Brazos County,
Texas, and being more particularly described as follows:
COMMENCING at a concrete right-of-way marker in the
northwest right-of-way line of F.M. 2818 at the most
easterly corner of the said 7. 68 acre tract ;
THENCE S 50° 09 ' W - 463. 5 feet along the said right-of-
way line and the southeast line of the said 7. 68 acre
tract to a concrete right of way marl&r;
THENCE S 64° 58 ' W - 27. 5 feet to an iron rod set at the
Point of Beginning of this tract;
THENCE S 64° 58 ' W - 275. 0 feet continuing along the
southeast line of the said 7. 68 acre tract and the north-
west right-of-way line of F.M. 2818 to an iron rod set at
the most southerly corner of this tract;
THENCE N 25° 02' W - 275. 0 feet across the said 7. 68
acre tract and into the said 39. 98 acre tract to an iron
rod set for the most westerly corner of this tract ;
THENCE N 64° 58 ' E - 275. 0 feet through the said 39 . 98
acre tract and the said 7. 68 acre tract to an iron rod
set for the most northerly corner of this tract;
THENCE S 25° 02 ' E - 275. 0 feet to the Point of Begin-
ning.

SAVE AND EXCEPT All of the oil, gas, and other minerals
in, on, or under the above-described tract or parcel of
land, which minerals are hereby reserved to the Grantor/
Seller, PROVIDED, that no drilling or other activities
for the production of such oil, gas and other minerals
shall ever be conducted upon the surface of the said
tract, it being the intention of the parties that any
mineral production or development activity shall take
place solely by virtue of drilling or other operations on
'adjacent lands, and Grantor/Seller hereby waives any and
all rights to use the said surface estate for such pur-
poses, or for ingress or egress to the site of any such
operations, in perpetuity, this provision to be binding
and effective as to the successors, heirs, and assigns of
each party hereto.
THIS CONVEYANCE IS SUBJECT TO THE FOLLOWING:
1 . Mineral Reservation as set out in Deed
dated July 1 , 1968 from C. M. R. Deacon et ux to Dorsey
E. McCrory, recorded in Volume 271 , Page 259 of the Deed
Records of Brazos County, Texas.
2. Royalty reservation as set out in deed
dated May 25, 1961 , from P. G. Longmire to Roy William
Kelley, recorded in Volume 211 , Page 615 of the Deed
Records of Brazos County, Texas .
TO HAVE AND TO HOLD the above described premises, toge-
ther with all and singular the rights and appurtenances thereto in
anywise belonging unto the said THE CITY OF COLLEGE STATION, its
successors and assigns forever, and I do hereby bind myself, my
heirs, executors and administrators to WARRANT AND FOREVER DEFEND,
all and singular the said premises unto the said THE CITY OF
COLLEGE STATION, its successors and assigns, against every person
whomsoever lawfully claiming, or to claim the same, or any part
thereof.
Taxes for the year 1981 will be prorated to the date of
this deed, and payment thereof is to be made by Grantee herein
upon receipt of the statements for said tares.
WITNESS my hand at College Station, Texas , this the
day of July, 1981 .
