Grantee will notify grantor prior to the first entry to the property for the purpose of delivering materials or beginning construction. • 2. In the event the back-fill from the sewer line settles below the existing natural ground level , the City of College Station agrees to do the things necessary to bring the ground back to said natural ground level . This agree- ment for maintenance shall inure to the benefit of Richard Smith only and shall terminate upon divestiture of title by any means except death to the above-described property. 3. The land upon which this easement lies is presently being used for the purpose of grazing livestock. Grantee shall be responsible for assuring that fences and gates are maintained in such a manner as to prevent said livestock from escaping the premises. 4. The said twenty (20) foot easement shall continue only so long as Grantee herein shall use this easement for the purpose herein described and the same shall immediately lapse and terminate upon cessation of such use. TO HAVE AND TO HOLD the same perpetually to the City of College Station , Texas, and its successors, together with the right and privilege at any and al) times to enter said premises, or any part thereof, for the purpose of co►,structing, re-constructing, and maintaining the said sewer line facility on the condition that the City of College Station, Texas, work in connection with the consruction, re-construction, and repairing of said sewer line facility, restore said premises to the condition in which same were found before such work was undertaken and that in the use of said rights and privi- leges herein granted, the said City of College Station, Texas, and its suc_- . cessors will not create a nuisance or do any act that will be detrimental to said premises. An additional easement for construction purposes is granted for a period of one (1 ) year from the date hereon, said construction easement being a one hundred (100) foot wide strip of land and the centerline of said construction easement following the centerline of said twenty (20) foot wide easement.
