HomeMy WebLinkAbout1970-0684 - Ordinance - 05/25/1970ORDINANCE NO. 684 AN ORDINANCE TO REZONE TRACTS 11, 12 AND 13, WHICH ARE 2.988, 2.988, AND 2.990 ACRE TRACTS OF LAND, RESPECTIVELY, IN THE MORGAN RECTOR LEAGUE, LOCATED ON THE NORTHWEST SIDE OF KRENEK LANE ( FORMERLY STASNEY LANE), FROM DISTRICT NO. 1, FIRST DWELLING HOUSE DISTRICT TO DISTRICT NO. 3-A, MOBILE HOME PARK DISTRICT, BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Council held a public hearing in the City Hall at 7:00 p.m. on May 25, 1970 on the question of rezoning certain areas within the city limits; AND, WHEREAS, the City Council has determined the following: To rezone or change the classification of the following described tracts: Tract No. 11: A 2.988 acre tract or parcel of land lying and being situated in the Morgan Rector League, Brazos County, Texas, and being part of the tract of land conveyed to Glynn A. Williams, L. E. Winder, Jr., and C. W. King by deed recorded in Volume 254, Page 432, of the Deed Records of Brazos County, Texas, and being more particularly described as follows: Beginning at an iron rod in the northwest line of Stasney Lane located S 450 00' W 1736.46, feet from the iron rod marking the east corner of the above mentioned Williams, Winder and King tract; thence N 450 00' W for a distance of 750.00 feet to an iron rod in the northwest fence line of said Williams, Winder and King tract; thence S 440 44' 53" W along a fence line for a distance of 173.64 feet to an iron rod for corner; thence S 450 00' E for a distance of 749.23 feet to an iron rod for corner in the northwest line of Stasney Lane; thence N 450 00' E along the northwest line of Stasney Lane for a distance of 173. 63 feet to the Place of Beginning, containing 2. 988 acres of land, more or less, from District No. 1, first dwelling house district to District No. 3-A, Mobile Home Park District. Tract No. 12: A 2. 988 acre tract or parcel of land lying and being situated in the Morgan Rector League, Brazos County, Texas, and being part of the tract of land conveyed to Glynn A. Williams, L. E. Winder, Jr. and C. W. King by deed recorded in Volume 254, Page 432, of the Deed Records of Brazos County, Texas, and being more particularly described as follows: Beginning at an iron rod in the northwest line of Stasney Lane located S 450 00' W 1910. 09 feet from the iron rod marking the east corner of the above mentioned Williams, Winder and King tract; Thence N 450 00' W for a distance of 749. 23 feet to an iron rod in the northwest fence line of said Williams, Winder and King tract; thence S 440 33' 26" W along a fence line for a distance of 173. 88 feet to an iron rod for corner; Ordinance No. 684 Page 2 Thence S 450 00' E for a distance of 747. 90 feet to an iron rod for corner in the northwest line of Stasney Lane; thence N 450 00' E along the northwest line of Stasney Lane for a distance of 173. 88 feet to the Place of Beginning containing 2.988 acres of land, more or less, from District No. 1, first dwelling house district to District No. 3-A, Mobile Home Park District. Tract No. 13: A 2.990 acre tract or parcel of land lying and being situated in the Morgan Rector League, Brazos County, Texas, and being part of the tract of land conveyed to Glynn A. Williams, L. E. Winder, Jr., and C. W. King by deed recorded in Volume 254, Page 432 of the Deed Records of Brazos County, Texas and being more particularly described as follows: Beginning at an iron rod in the northwest line of Stasney Lane located S 450 00, W 2083. 97 feet from the iron rod marking the east corner of the above mentioned Williams, Winder and King tract; thence N 450 00' W for a distance of 747. 90 feet to an iron rod in the northwest fence line of said Williams, Winder and King tract; thence S 450 00' 00" W along a fence line for a distance of 174.12 feet to an iron rod for corner; thence S 450 00' E for a distance of 747. 90 feet to an iron rod for corner in the northwest line of Stasney Lane; thence N 450 00' E along the northwest line of Stasney Lane for a distance of 174. 12 feet to the Place of Beginning containing 2.990 acres of land, more or less, from District No. 1, first dwelling house district to District No. 3-A, Mobile Home Park District. And, it is so ordained that said changes in Tracts No. 11, 12 and 13, as described above, become effective immediately. PASSED AND APPROVED this 25th day of May, 1970. APPROVED: '�6a�hiov Mayor ATTEST. - City Secretary Rezoning conditioned upon : (a) ,If the petition for curb ;and gutter paving is unsuccessful, Krenek Tap Road would be surfaced by the city by Open Ditch Policy, and Mr. Swoboda . will pay the total property owners share of the construction costs, and as the assessments are levied against the property owners, and collected, Mr. Swoboda will be reimbursed. The length of paving will be determined by the City Engineer. (b) Dedication of a north -south bound street located approximately 1, 000 to 1, 200 feet east of and parallel to Highway 6.
