MEMBERS PRESENT: MEMBERS ABSENT: VISITORS PRESENT: Mayor Halter, Councilmen Ringer, Boughton, Kelly, Jones, Runnels, City Manager Bardell, City Planner Mayo, City Engineer Ash, Traffic Engineer Black, Purchasing Agent Weddle, Parks and Recreation Director Beachy, Assistant Planner Longley, Chief Accountant Piazza, Administrative Analyst Albrecht, Assistant City Manager, Finance Van Dever Councilman Dozier See guest register Councilman Dozier was excused from the meeting to attend the Brazos Valley Development Council meeting. Agenda Item No. 1--Approval of minutes. Councilman Ringer moved approval of the minutes as read. Councilman Runnels seconded the motion, which passed unanimously, Councilmen Boughton and Jones not yet in attendance. Agenda Item No. 2--A public hearin~ on the question of rezoning the following two tracts: A 24.81 acre tract ~enerally located east of and adjacent to Texas Avenue and appro~m~t.ely 800 feet south of the intersection of Texas Avenue and the East Bypass from Agricultural/Open District A-O to General Commercial District C-1. A 63.69 acre tract located east of and adjacent to Tract No. 1 from Agricultural/ ppen District A-O to Townhouse District R-3. City Planner Mayo presented the plat and answered questions of the Council. The Public Hearing was opened, and Councilman Boughton joined the meeting. Eddie Schultz, Raintree Development Partner, answered questions of the Council and explained proposed plans for the tracts. The Public Hearing was closed. A8enda Item No. 3--Consideration of an ordinance rezoning the above two tracts. Coucilman Runnels questioned City Planner Mayo about present commercially zoned areas and the percentage of those that are currently occupied as such. Councilman Jones j~in~d the meeting at this time. OZ967 Councilman Jones moved approval of the rezoning of the two tracts, creating Ordinance No. 1223. Agenda Item No. 4 -- A public hearing on the question of rezonin~ a 4.5 acre tract ~ener~l~M located at the southwest corner of the intersection of Dowlin~ Road and F.M. 2818 from Singl~ Family Residential District R-1 to Administrative Professional District A-P. The application is in the name of Edsel G. Jones. City Planner Mayo presented and explained the plat. The public hearing was opened. Edsel Jones, owner, explained the proposed use for the tract. Elmer Thompson pointed out that the comprehensive plan revision was being considered and yet the City is constantly rezoning areas. Agenda Item No. 5 -- Consideration of an ordinance rezoning the above tract. Councilman Kelly moved to rezone the tract, creating Ordinance No. 1224. Councilman Boughton seconded the motion, which passed unanimously. Agenda Item No. 6 -- Consent A~nda. a. Consideration of a final plat - The Ramparts - located at the intersection of Church Street and Na~le Street. b. Consideration of bids for PVC water main pipe and miscellaneous equipment. Staff recommended Utility Supply Co. for $3,044.13. c. Consideration of purchase of solid waste disposal vehicle. Councilman Runnels asked that item c be pulled from the consent agenda. Councilman Ringer moved approval of items a & b. Councilman Runnels seconded the motion, which passed unanimously. City Manager Bardell stated that item c had previously been approved and could be struck entirely from the agenda. Agenda Item No. 7 -- Consideration of an ordinance fixing the schedule of water and sewer rates. Assistant City Manager, Finance Van Dever presented the proposed ordinance and noted changes from the previous rate ordinance, No. 1145. He also recommended a change in Section 2 to avoid penalizing paid balances on a partially paid bill. Councilman Runnels suggested that in Section 3, the words "on or before" be replaced by the word "by". REGULAR CITY COUNCIL MEETING June 26, 1980 7:00 P.M. Councilman Runnels moved to adopt the proposed ordinance with the changes stipulated above. This creates Ordinance No. 1225. Councilman Kelly seconded the motion, which passed unanimously. page 3 Agenda Item No.8--Consideration of an ordinance setting the tax rate for the fiscal year 1980-1981. Councilman Kelly moved to adopt Ordinance 1226, setting the tax rate at 39¢ per $100. Councilman Jones seconded the motion, which passed unanimously. Agenda Item No. 9--Consideration of an ordinance ~doRt%Dg the budget for the fiscal year 1980-1981. Assistant City Manager, Finance Van Dever answered questions of the Council. Councilman Kelly moved to approve the budget for the fiscal year 1980-1981, creating Ordinance No. 1227. Councilman Runnels seconded the motion, which passed unanimously. Agenda Item No. 10--Consideration of a resolution apRlyin~ for additional funds for College Station Central Park light~n~. Parks and Recreation Director Beachy explained the resubmission of the applica- tion and answered questions of the Council. Councilman Ringer moved approval of Resolution No. 06-26-80-10. Councilman Jones seconded the motion, which passed unanimously. Asenda Item No. il--Consideration of authorization for permit to construct a 30 inch water line beneath the Missouri Pacific Right-of-Way at Mile Point 80.2, Engineer's Chainage Station 1072+47,. Brazos County, Texas. City Engineer Ash explained the need for authorization by the Council for permission to construct the water line. Councilman Ringer moved that the Mayor be authorized to sign the permit. Councilman Kelly seconded the motion, which passed unanimously. Asenda Item No. 12--Hear Visitors. No one spoke. A~enda Item No. 13--Closed session to consider land acquisition and possible pending litigation. Councilman Kelly moved to pay Glen Broderick $407.83 for damages caused to his car by a City vehicle. Councilman Ringer seconded the motion, which passed unanimously. Agenda Item No. 15--Adjourn.
