MEMBERS PRESENT: Mayor Halter, Councilmen Ringer, Boughton, Kelly, Jones, Runnels, City Manager Bardell, Student Liaison Herring, Tax Assessor-Col- lector Schroeder, Energy Coordinator Albrecht MEMBERS ABSENT: Councilman Dozier VISITORS PRESENT: See guest register A~enda Item No. 1--Council Concerns. City Manager Bardell said that a check valve had been installed at Larry Christenson's house and the sewer problem was taken care of. Agenda Item No. 2--Discussion of proposed childcare ordinace. Mayor Halter asked Ms. Albrecht to go over the proposals made in the proposed ordinances and to bring the Council up to date on this particular situation. Ms. Albrecht stated that Proposal A included all of the state regulations. Mayor Halter asked her to explain the present ordinance in comparison with the proposed ordinance. Ms. Albrecht stated that Ordinance #527 now on the books is not enforced because it is too lengthy and includes many of the state requirements. City Manager Bardell pointed out that proposal A was a revision to the present Ordinance which parallels and restates mamy state regulations. Ms. Albrecht then pointed out that proposal B eliminated all of the state regulation, except the Fire Code. She pointed out i~ raised the requirement for a permi~ from four to seven children, since seven is state requirement. She pointed out another difference was the requirement for at least one person on duty to be currently certified of the completion of the American Red Cross Course in First Aid or the equivalent. A First Aid program will be offered through the Fire Department. Ms. Albrecht stated that these changes came about from suggestions made by Randy French of French's Schools. She pointed out the state does not regulate Centers with under seven children. It does have some regulation for those having from seven to twelve, but m~e strict regulation" .~o~ those having above twelve children. Mayor Halter asked what the effect of a regulation on the seven to twelve limit would have on the Zoning Ordinance. ~. Albrecht stated they would then have to get a Conditional Use Permit from the Planning and Zoning Commission. It was then pointed out that the state did make adaquate inspections and that proposal B only had a few duplications of state requirements. The Council decided to discuss proposal B section by section. Mayor Halter stated that section one was not a problem. Section two defines Group Day Care Center, Day Care Center and Child Care and/or Development Facility. Section three states it shall be unlawful to operat~ ~ child-care and/or 4evelopment facility without a pezmit. She stated the changes that had been made in this section ~ncluded medications previously ~?~ required to be stored in a locked cabinet were now required to be stored above a child's reach. The City of College Station will offer, through the Fire Department, a First Aid Course. The Council then discussed the various First Aid Courses offered in the Community. Ms. Albrecht stated section C was a carry-over from the original Ordinance. She said it was simply a reminder of Common sense practiced and that section D takes old qual- ifications of Ordinance #527 and allows persons operating at present to continue under the old requirements. Judy Warren commented that the care giver is the most important factor in taking care of a child. She thought the City, since they are issuing permits, should have a progrc to educate care givers such as workshops to provide information to parents and care givers. After much discussion the Council decided this was not the place of the City. It was then discussed that the quality of Cild Care Centers chosen by a parent were a matter of personal preference by parents and child. Mayor Halter suggested going on to section E, Location and Construction Requirements. There were no questions on this matter. The Council moved on to section six, Penalty for Violation. Ms.Albrecht stated if a permit was revoked a hearing could go before the City Manager. If the individual still felt he was discriminated against the matter would go before the City Council. Mr. French asked at what point did the City have the authority ~o close down a ¢~er. City Manager Bardell stated he interpreted the proposed ordinance as giving a Center ten days after notification of a violation to appeal to the City Manager, where he co,lr be given an extension to epeal to the City Council. The Council decided there were instances when the City needed the authority to demand immediate closing of a center. Agenda Item No. 3--Adjourn.
