MEMBERS PRESENT: Councilmen Ringer, Boughton, Dozier, Halter, Hazen, Adams; Mayor Bravenec, City Manager Bardell, City Engineer Ash, City Planner Mayo, Director of Public Works Ford, Assistant Planner Longley, Community Development Planner Calloway, Fire Chief Landua, Fire Marshall Davis, City Attorney Lewis, Assistant Parks Director Czimskey, Administrative Assistant to the City Manager Allbrecht MEMBERS ABSENT: None GUESTS PRESENT- See guest register ~g~enda Item No. 1--Approval of minutes of the previous meetings. Mayor Pro-Tempore Halter called the meeting to order and asked for any corrections to the minutes. City Manager Bardell said that in Item 3 of the January 11 minutes, his statement referred to the Detroit street contractor. Councilman Ringer moved approval of the minutes as corrected. Councilman Hazen seconded the motion, which passed unanimously. Agenda Item No.2--Hear Visitors. No one spoke. Agenda Item No.3--A Public Hea._r. ing ..on the question of rezoning.a 1.0. _ acre tract located on the northeast corner of the intersection of Texas Avenue and Rock Prarie Road from Agricultural-OPen District A-O to General Commerical District .C,-~i. The appli, q~tion~.is in the name of Mr. Freddie Curry. City Planner Mayo presented and explained the plat. He said that the P&Z had approved the rezoning. The Public Hearing was opened. No one spoke, and the hearing was closed. .A_genda Item No.4--Considera_tion of ..a.n..ordinance rezoning the above tract. Councilman Dozier moved approval of Ordinance 1143. Councilman Hazen seconded the motion. Councilman Adams said that the zoning ordinance should be changed in order that the whole area could be rezoned rather than by small tracts at a time. Page 2 District R-1. The application i.s.in .the n.a..m.e._of.H, ald.e.c, Inc. Mayor Bravenec took the chair from Mayor Pro-tempore Halter. City Planner Mayo presented and explained the plat, and said that P&Z had recommended the rezoning. The Public Hearing was opened. Allen Swoboda said that this was being presented now because of a previous over sight on his par t. The Public Hearing was closed. Agenda Item No.6--Consideration of an ordinance ..r..ez_oning the above tract. Councilman Dozier moved that Ordinance 1144 be approved. Councilman Halter seconded the motion, which passed unanimously. Agenda Item No. 7--Discussion and action concerning the fire lane ordinance application in Culp~pper Plaza. City Manager Bardell explained the situation in Culpepper Plaza, and City Engineer Ash told of J. C. Culpepper's consent to conform to the ordinance by failing to apply for a new site plan. Mayor Bravenec asked City Manager Bardell to contact the merchants in the center and tell them of Mr. Culpepper's decision. He also asked the staff to draw up an ordinance which would bring all shopping centers of this type into conformity. Councilman Dozier moved that the staff be instructed to enforce the fire lane ordinance throughout the city. Councilman Boughton seconded the motion, which passed unanimously. _A_.genda ~tem No._8-_,Public Hearing .on~_P_ropo_sed Rate Ordinances_: on Water, Sewer and Electricity_. Councilman Ringer expl. ained the decisions of the Utility Rate Study Committee. The Public Hearing was opened. Roy Hahn, 1300 Walton Drive, said that he believed master-metered apartment complexes should be allowed the 10% discount as were the sub-metered units. Carl Barby said the sub-metered units use less energy than those units with master meters. Bill Sisson spoke saying that a cost of service study should be done. Chuck Harty asked for a cost of service study and stated that he thought the 10% discount should be dropped and a 25 point list should be used to base the discount on. Jim Gardner questioned the sewerage figures and asked that a cost of service study be done. Councilman Ringer moved approval of Ordinance 1145, with date to be effective to be changed to March 1, 1979. Councilman Boughton seconded the motion, which passed unanimously. Councilman Ringer moved approval of Ordinance 1146, with date to be effective to be changed to March 1, 1979. Councilman Hazen seconded the motion, which passed unanimousl'y. Councilman Halter asked the City Manager to look into a cost of service study, its cost and possible benefits. Councilman Ringer asked for a letter to be sent to the Utility Rate Study Committee members thanking them for their work. Agenda Item No.10--Co.ns..ideration of authorization .0f~_.t_aking bids on the Fire Sub Station. Timothy Keneipp, architect, presented the cost estimates and asked for authorization to take bids on the building. Councilman Hazen moved authorization of Keneipp to take bids for the building. Community Development Planner Calloway explained recent HUD. statements concerning the Housing Association, and lack of funds allocated for this area. Councilman Dozier moved to table this matter and a committee be appointed to work with the City Staff on the problem. Councilman Adams seconded the motion, which passed unanimously. The committee members are Mayor Bravenec, and Councilmen Halter and Hazen. Agenda Item No 12--Consideration of bids for automobile for Tax Assessor- Collector. City Manager Bardell recommended the low bid by Lawrence Marshall Chevrolet for $5,021.57. Councilman Dozier moved to accept the recommendation. City Engineer Ash explained the minute order and asked for the Mayor's authorization to sign it. Councilman Dozier moved to authorize the Mayor to sign the minute order. Councilman Ringer seconded the motion, which passed unanimously. Agenda Item No. 14--Closed Session to consider land acquis.i~ion an~d possible Pending litigation. L_. The Council went into closed session, and returned. Councilman Boughton moved that a contract with Margaret Higgs Stephens be executed to buy 7.07 acres for $4000 an acre for a water pump station. Councilman Ringer seconded the motion, which passed unanimously. Councilman Boughton moved to purchase 6.043 acres from Brazos County ~101 Limited for a ground storage and pump station site. Councilman Ringer seconded the motion, which passed unanimously. Agenda Item No.15--Council Concerns. Councilman Dozier asked when the next election would be called. Councilman Adams asked if the computer was working okay after its recent shut down. Mayor Bravenec related details of his meeting with Bryan and the Highway Department earlier in the day.
