Regular City Council Meeting
July 12, 1977

Agenda Item No. 1 -- Consideration of an ordinance annexing approximately
1600 acres bound by the East Bypass~ Harvey Road, Carters Creek, Bird Pond
and Rock Prairie Roads.
Councilman Gardner noted that there might be some legal problems due to pro-
cedures followed in publishing and discussion of the proposed ordinance.
Councilman Stephenson moved approval of the ordinance annexing approximately
1600 acres bound by the East Bypass , Harvey Road, Carters Creek, Bird Pond
and Rock Prairie Roads.
Councilman Ringer seconded the motion.
The motion to approve the ordinance annexing approximately 1600 acres bound
by the East Bypass, Harvey Road, Carters Creek, Bird Pond and Rock Prairie
Roads failed by the following vote:
FOR --- Mayor Bravenec; Councilmen Ringer and Stephenson
AGAINST --- Councilmen Gardner, Dozier, Halter and Hazen
Councilman Halter moved to follow the procedures specified in the City Charter
and in State Law, publishing the ordinance twice before adoption.
Councilman Gardner seconded the motion.
The motion to follow the procedures specified in the City Charter and in
State Law, publishing the ordinance twice before adoption, passed by the
following vote:
FOR --- Mayor Bravenec; Councilmen Ringer, Gardner, Halter and Stephenson
AGAINST --- Councilmen Dozier and Hazen
Agenda Item No. 2 -- Discussion of progress on ~oals objectives. (Building
Official)
This item was delayed until after Agenda Item No. 8 -- Discussion of drive
entrances to Culpepper Plaza, Phase II.
Agenda Item No. 3 -- Consideration of a master preliminary plat -- Raintree.
City Planner Mayo described the plat.
Mr. E.W. Schultz, managing partner of Raintree Developments, described the

proposed plat and the park dedications involved.
Councilman Dozier moved approval of the master preliminary plat for Raintree.
Councilman Hazen seconded the motion.
The motion to approve the master preliminary plat for Raintree passed by the
following vote:
FOR --- Mayor Bravenec; C~uncilman Ringer, Dozier, Halter, Stephenson, Hazen
AGAINST --- Councilman Gardner
Councilman Dozier moved to reconsider, in order to include accepting the
Planning and Zoning Commission's recommendations.
Councilman Halter seconded the motion.
The motion to reconsider passed unanimously.
Councilman Dozier moved to approve the preliminary plat for Raintree,
according to the Planning and Zoning Commission's recommendations.
Councilman Hazen seconded the motion.
The motion to approve the master preliminary plat for Raintree, according to
the Planning and Zoning Commission's recommendations passed by the following
vote:
FOR --- Mayor Bravenec; Councilmen Ringer, Dozier, Halter, Stephenson, Hazen
AGAINST --- Councilman Gardner
Agenda Item No. 4 -- Consideration of a preliminary plat -- Raintree Phase II.
The plat passed by consent of the Council.
Agenda Item No. 5 -- Consideration of a final plat -- Southwood Valley~
Section 7-C.
The plat passed by consent of the Council.
Agenda Item No. 6 -- Consideration of a preliminary plat -- The Woodlands
located in the E.T.J. on Dowling Road.
City Planner Mayo described the plat.
Director of Public Works Ford reviewed the county standards.
C~uncilman Halter moved approval of the preliminary plat for the Woodlands,
located in the E.T.J. on Dowling Road with the stipulation that a statement
be included that the City will bear no cost of sewerage if the Woodlands were
to be annexed in the future and to accept the Planning and Zoning Commission's
recommendations to the plat.

Councilman Hazen seconded the motion.
Councilman Stephenson moved to amend the motion to show easements on each
lot line, side lot lines included, on the plat.
Councilman Hazen seconded the motion to amend.
The motion to amend the original motion to show easements on each lot line,
side lot lines included, on the plat passed by the following vote:
FOR --- Mayor Bravenec; Councilmen Gardner, Stephenson and Hazen
AGAINST --- Councilman Dozier
ABSTAINING --- Councilmen Ringer and Halter
The motion to approve the preliminary plat for The Woodlands, located in the
E.T.J. on Dowling Road, with the stipulation that a statement be included

Agenda Item No. 7 -- Consideration of a final plat resubdividin~ Lots 2 and 3,
Block 1; South College Park Addition.
Mr. John Garner, owner of Lot 3A, described the plat and the need for resub-
division.
Councilman Halter moved approval of the plat.
Councilman Gardner seconded the motion.
The motion to approve the plat was approved unanimously.
Agenda Item No. 8 -- Discussion of drive entrances to Culpepper Plaza~ Phase II.
Mr. John Culpepper described the need for a review of the drive entrances.
City Engineer Ash explained the City's position in the situation.
Councilman Halter moved that the City take the appropriate action to get a
left hand turn lane placed on Texas Avenue at the point across from the second
curb cut of Culpepper Plaza north of Highway 30, to provide access to the
main boulevard entrance to Culpepper Plaza and to accept the second curb cut
north of Highway 30 on Texas Avenue and to close the first curb cut north
of Highway 30 ( next to the Exxon station) on Texas Avenue at such time that
the Texas Highway Department allows the previously mentioned left hand turn
lane to be constructed; to also allow the service entrance curb cut on Texas
Avenue ( third curb cut north of Highway 30 ) ; that the two curb cuts on
Dominik be allowed and that the recommendations of the Project Review
Committee be followed.

Agenda Item No. 2 -- Discussion of pro§ress on goals objectives.

Building Official Koehler reviewed his goals objectives.
Mayor Bravenec noted that Urban Forester Ploeger could be of help in meetings
set up to review the landscaping of parking lots.
Building Official Koehler stated that two (2) ordinances, Ordinance No. 175 -
defining a public nuisance and Ordinance No. 628 - the Housing Code, are
necessary to allow the City to take action to assess the cost of removal of
substandard houses.
Building Official Koehler explained the difference between the City filing
a complaint and the aggrieved party filing a written statement complaining
of clutter, etc. in yards.
Building Official Koehler reviewed policies and research being done concerning
required upkeep of smoke detectors.
Councilman Ringer noted that an ordinance could be instituted that required
smoke detectors to be functional, with a fine if the smoke detector remains
inoperable after a complaint procedure is followed.
Councilman Halter reviewed discussions of the Energy Efficiency Community.
Mayor Bravenec noted that a citizens information handbook which would give
necessary information to new citizens concerning utilities, complaints,
elections, etc. was a good idea.
A~enda Item No. 9 -- Closed session to discuss personnel and land acquisition.
Mayor Bravenec called the Council into closed session.
The Council convened to open session.
