HomeMy WebLinkAbout1983-1486 - Ordinance - 12/08/1983ORDINANCE NO. 1486 AN ORDINAIICE REZONING A PART OF THE SHENANOOAH SUBDIVISION AND A TRACT OF LAND LYING AND BEING SITUATEO IN THE ROBERT STEVENSON LEAGUE A-54, IN BRAZ05 COUNTY, COLLEGE STATION, TEXAS, AND BEING MORE FULLY DESCRIBED IN THE BODY OF THIS OROINANCE, FROM AGRICULTURE- OPEN SPACE OISTRICT A-O TO PLANNEO UNIT OEVELOPMENT CLASS 2. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M. on Thurs- day, Dec~slber 8, 1983, on the question of rezoning certain areas within the Clty Limits; AND, WHEREAS, the City Councll has determined the following: To rezone or change the classification of a part of the Shenandoah Subdivision and a tract of land lying and belng situated in the Robert Stevenson League A-54, Brazos County, College Station, Texas, which was conveyed to the owner by deed dated November 1, 1982 and recorded In Volume 345 Page 694 of the Brazos County Deed Records, and being a part of the plat recorded In Volume 590 Page 251 of the Deed Records of arazos County, and being more fully described as follows: TRACT NO. I (A part of the Shenandoah Subdivision) Lots 1 through 7 Block 2; Lots 1 through 16 Block 1; Lots 1 through 8 Block 3; and, Lots I through 7 Block 4, from Agriculture-Open Space Dlstrlct A-O to Planned Unit Development Class 2. TRACT NO. 2 Being all of that certain tract of parcel of land, lying and being situated in the ROBERT STEVEfISON LEAGUE A-54, In Brazos County, College Station, Texas and being described as follows: COMMENCING: at the most Easterly corner of SHENANDOAH PHASE THREE as approved but yet to be recorded by the City of College Statlon, Texas; THENCE: S 45°02'26" W - 308,86 feet to the PLACE OF BEGINNING: THENCE: S 45°02~26' W - 305.00 feet to a point for corner; THENCE: N 4q°57'34'' w - 145.00 feet to a point for corner; THENCE: N 45°02~26'' E - 15.00 feet to a point for corner; THENCE: N q4°57'34' W = 339.1q feet to a point for corner; THENCE: N 45°02~26'' E - 290.00 feet to a point for corner; THENCE: S 44057'34'` E - q84.1q feet to the POINT OF BEGINNING; and containing 3.2731 acres of land, more or less, according to a survey made under the supervlslon of Donald O. Garrett, Reglstered Publlc Surveyor in November 1983, from Agriculture-Open Space Olstrlct A-O to Planned Unlt Oevelopment Class 2. ATTEST: City Secretary~Han Jones COLLEGE STATION P O Box 9960 1101 Texas Avenue College Station TX 77842 Tel' 409 764 3500 March 13, 2003 Edward Froehhng 3887 High Lonesome College Stabon, TX 77845 via facslrn#e @ 774,0565 and via regular mall re the 3 273-acre tract southeast of W~ndswept Dnve College Station, Texas Dear Mr Froehhng On December 8, 1983, the City Council rezoned the above referenced property from A-O Agricultural Open to PUD #2 Planned Umt Development D~stdct (Ordinance No 1486) Section 5-0 3 of the Zomng Ordinance ~n effect in 1983 (Ordinance No 850) stated that PUD zoning requests required that preliminary subdivision plats and prehminary development plans will be sent forward to the City Council w~th a recommendation for approval of the zone change request under the condibon that the final plat and final development plan w~th all related ~nformation shall be presented to the Council, through the Commission, w~thin one (1) year from the date of approval of the zone change request; otherwise, the zoning shall revert to that prior to the request. As the City of College Station d~d not receive the final plat and final development plan for the 3.273-acre tract to the southeast of Windswept Drive, the land has reverted back to the previous zoning of A-O ~n accordance with Section 5-0 3 of Ordinance No 850 (mirrored in Secbon 7 19.D of the current Zoning Ordinance) The zoning for the subject property will be updated on the official Zoning Map.
