Halter Patrlcia Boughton Lynn Nemec McIlhaney Bob Runnels Alvin Prause GaryAnderson Vicki Reinke D~an Jones North Bardell Lowell Denton and all of said persons were present, absentees: City Manager Bardell to-wlt: Mayor Counc~lmember Councllmember Counc~lmember Councllmember Counc~lmember Councilmember City Secretary City Manager City Attorney except the following thus constituting a quorum. W"nereupon, the following [among other] business was transacted at said meeting: a written ordinance entitled ORDINANCE APPOINTING TWO DIRECTORS TO THE BOARD OF DIRECTORS OF THE LONE STAR MUNICIPAL POWER AGENCY; PRESCRIBING TERMS OF OFFICE; CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY was duly introduced for the consideration of said and read ~n full. Counc~lmember 8ou~hton made a motion that the ordinance be adopted. Councllmember Runnels seconded the motion for adoption of the ordinance. The motion, carrying with it the adoption of the ordinance, prevailed by the following vote: AYES: Seven NOES: None The Mayor thereupon announced that the ordinance had been duly and lawfully adopted and was ~n full force and effect. The ordinance thus adopted follows: OT~DINANCE NO. 1482 ORDINANCE APPOINTING TWO DIRECTORS TO THE BOARD OF DIRECTORS OF THE LONE STAR MUNICIPAL POWER AGENCY; PRESCRIBING TERMS OF OFFICE; CONTAINING OTHER PROVISIONS RELATING TO TRESUBJECT; AND DECLARING ANEMERGENCY WHEREAS, the City of College Station, Texas adopted a concurrent ordinance on this date (the "Concurrent Ordinance"), establ~shlng and creating the Lone Star Munlc~pal Power Agency (the "Agency") pursuant to the provisions of Article 1435a, V.A.T.C.S., as amended, specifically the provisions of Section 4b thereof; and WHEREAS, Section l(c) of the Concurrent Ordinance provides that the Agency shall be governed by a Board of Directors consisting of e~ght (8) persons who are qual~fled electors residing w~thln the boundary of the Agency, who shall serve by places; and WHEREAS, Section 2 of the Concurrent Ordinance provides for the appointment of two persons by the governing body of the City of College Station to serve on the Board of Directors of the Agency; and WHEREAS, the C~ty Council, which ~s the governing body of the City of College Station, now desires to appoint two persons to serve on the Board of D~rectors of the Lone Star Municipal Power Agency; BE IT ORDAINED BY COLLEGE STATION: Section 1. The Now, Therefore: THE CITY COUNCIL OF THE CITY OF City Council hereby appoints the following persons to serve on the Board of D~rectors of the Lone Star Municipal Power Agency for the following initial terms of off~ce: Place D~rector Initial Term Endlnq Gary M. Halter North B. Bardell Second Tuesday ~n March 1984 4 Second Tuesday ~n March 1985 Ordinance No. 1482 Section 2. The recitals contained in the preamble hereof are found to be true and are adopted as findings of fact by this City Council. Section 3. The City Council officially finds, recites and declares that a sufficient wrltten notlce of the date, hour, place and subject of this meeting of the Clty Council was posted at a place convenient to the public at the C~ty Hall of the City for the tlme requlred by law preceding th~s meeting and that such place of posting was readlly accessi- ble to the general public at all t~mes from the t~me of posting of such notice to the scheduled tlme of commence- ment of this meeting; that all of the foregoing was done as required by the Open Meetings Law, Article 6252-17, Vernon's Texas Clvil Statutes, as amended; and that this meeting has been open to the public as required by law at all t~mes during which thls Ordinance and the subject matter thereof has been d~scussed, considered and formally acted upon. The C~ty Council further ratifies, approves and conf=rms such written notice and the contents and posting thereof. The C~ty Council further officially finds and determines that a case of emergency and urgent public necessity exlsts whlch requires the holding of the meeting at which thls Ordinance is passed and approved, such emergency and urgent public necessity being the public ~mportance of appointing two persons to serve on the Board of Directors of a municipal power agency at the earliest possible date and that such emergency and urgent public necessity requires the consid- eration of such sub3ect even ~f th~s not~ce has not been posted for at least 72 hours preceding the scheduled t~me of such meeting and that the not~ce of this meeting expressed such emergency and urgent publlc necessity and was posted as required by law more than two hours before thzs meeting was -2- Ordinance No. 1482 convened and notice has been given by telephone to all news media requesting such notice to the extent required by law.
