WHEREAS, the City of College Station having determined the
necessity of extending Lincoln Street from its present dead
end at Ashburn Avenue to University Drive in College Sta-
tion; and
WHEREAS, the City Council having determined that it is nec-
essary to obtain the right-of-way on the property owned by
E.L. Putz, described on the attached Exhibits A and B to
this resolution, and that the public need requires the
acquisition of same in such manner as to make the property
available for lawful use for such purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of College Station that the right-of-way area de-
scribed on Exhibits A and B attached hereto shall be
acquired by the City; and the reasonable cash market value
of same shall be determined and paid according to law,
either by voluntary purchase or by condemnation; and that
the City Manager, the Mayor, and the City Attorney are
authorized to take any and all necessary actions to obtain
and pay for such property, including the marketable title
thereto, free and clear of any restrictions or covenants
inconsistent with the use of same for all lawful public
utility purposes. Further, that the City Attorney is by
this resolution expressly authorized to initiate and pursue
condemnation proceedings and any other necessary litigation
incident to the purpose herein set forth.

Metes and bounds description of all that certain 0.209 acre tract or
parcel of land lying and being situated in the Richard Carter
Survey, Abstract 8, College Station, Brazos County, Texas, and being
a part of a called 0.98 acre tract as described in a deed from Ed
Putz, et ux, to E.L. Putz, recorded in volume 129, page !4 of the
Deed Records of Brazos County, Texas. Said 0.209 acre tract being
more particularly described by metes and bounds as follows:
BEGINNING at a point being the east corner of said 0.98 acre tract
from which a 6 inch orner fence post bears S 80°31'04'' W for a
distance of 0.97 feet;
THENCE S 41001'34'' W along the southeast line of said 0.98
tract for a distance of 251.75 feet to a point being the
corner of said 0.98 acre tract;

tract for a distance of 41.35 feet to a 5/8 inch iron rod set, being
the west corner of this 0.209 acre tract;

235.49 feet to a 5/8 inch iron rod set in the northeast line of said
0.98 acre tract;
THENCE S 48005'26'' E along said northeast line for a distance of
36.91 feet to the PLACE OF BEGINNING containing 0.209 acres (9,100
square feet) of land more or less.

Metes and bounds description of all that certain 0.181 acre tract or
parcel of land lying and being situated in the Richard Carter
Survey, Abstract 8, College Station, Brazos County, Texas and being
part of a called 13.54 acre tract as described in deed from Ed ?utz,
et ux, to E.L. Putz ~ecorded in volume 287, page 820 of the Deed
Records of Bzazos County, Texas. Said 0.181 acre tract being more
particularly described by metes and bounds as follows:
BEGINNING at a 1/2 inch iron rod found marking the east corner of
said 13.54 acre tract, said iron rod also marking the south corner
of an 8.88 acre tract as described by deed in volume 452, page 163
of the Deed Records of Brazos County, Texas;
THENCE N 48°59'39'' W along the common line of said 13.54 acre tract
and said 8.88 acre tract for a distance of 36.12 feet to a 5/8 inch
iron rod set for corner;
THENCE S 41°14'06'' W through said 13.54 acre tract for a distance of
215.99 feet to a 5/8 inch iron rod set for corner in an interior
southwest line of said 13.54 acre tract;
THENCE S 48"05'26'' E along said southwest line for a distance of
