HomeMy WebLinkAbout12-13-84-17 - Resolution - 12/13/1984RESOLUTION NO. 12-13-84-17 WHEREAS, the City of College Station having determined the necessity of extending Lincoln Street from its present dead end at Ashburn Avenue to university Drive in College Sta- tion; and WHEREAS, the City Council having determined that it is nec- essary to obtain the right-of-way on the property owned by College Hills Company, described on the attached Exhibit A to this resolution, and that the public need requires the acquisition of same in such manner as to make the property available for lawful use for such purposes; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of College Station that the right-of-way area de- scribed on Exhibit A attached hereto shall be acquired by the City; and the reasonable cash market value of same shall be determined and paid according to law, either by voluntary purchase or by condemnation; and that the City Manager, the Mayor, and the City Attorney are authorized to take any and all necessary actions to obtain and pay for such property, including the marketable title thereto, free and clear of any restrictions or covenants inconsistent with the use of same for all lawful public utility pur- poses. Further, that the City Attorney is by this resolu- tion expressly authorized to initiate and pursue condemna- tion proceedings and any other necessary litigation inci- dent to the purpose herein set forth. Said 0.511 acre tract being more p~rticularly described as follows: BEGINNING at a 5/8 inch iron rod set for the north corner of Lot 1 of Woodland Estates as shown on plat of said Woodland Estates recorded in volume 108, page 223 of the Deed Records of Brazos County, Texas; THENCE S 41054'56'' W along the northwest line of said Lot 1, at 578.02 feet pass an iron rod found marking the north corner of a tract of land being part of said Lot 1 as described by deed recorded in volume 472, page 779 of the Deed Records of Brazos County, Texas, continue on for a total distance of 1130.16 feet to a point in the northeast line of Woodland Acres as shown on plat of said Woodland Acres, recorded in volume 104, page 322 of the Deed Records of Brazos County, Texas; THENCE N 49°38'19'' W along said northeast line for a distance of 19.33 feet to a point being the north corner of said Woodland Acres, said point also lying in the northwest line of said 200 acre tract; THENCE N 41052'37'' E along the northwest line of said 200 acre tract for a distance of 1130.11 feet to a point being the north corner of said 200 acre tract, said point also lying in a southwest line of tract No. 1 of Carter's Grove Second Installment Addition as shown on plat of said addition recorded in volume 228, page 161 of the Deed Records of Brazos County, Texas; THENCE S 49042'57'' E along said southwest line, for a distance of 20.09 feet to the PLACE OF BEGINNING and containing 0.511 acres (22,268 square feet) of land more or less.
