WHEREAS, the City staff has received numerous requests
by property owners for letters to the lending institutions
where there has been a setback encroachment by structures;
said setback boundaries previously set by City ordinance.
WHEREAS, the City staff has determined that a three inch
encroachment could be attributed to surveyor's error and
that this margin is acceptable to the staff. The staff
recommends that this not be considered an encroachment
requiring Zoning Board of Adjustment approval of a variance.
WHEREAS, the City Council has heard and considered the
recommendations of the City staff;
THEREFORE, BE IT RESOLVED THAT:
The City Staff is hereby authorized to consider a
setback encroachment of three inches or less as a surveyor's
error and therefore not an encroachment in violation of
City ordinance.
Further, be it resolved that the City staff is
authorized to issue letters where requested to lendors.
Said letters indicating that an encroachment of three inches
or less is within a tolerance acceptable to the City
Council and considered a surveyor's error and does not
need Zoning Board of Adjustment variance approval.
