AN ORDINANCE BY WHICH THE CITY OF COLLEGE STATION, TEXAS,
UNDERTAKES TO COMPLY WITH CERTAIN FEDERAL ENERGY REGULATORY
COMMISSION REGULATIONS PROVIDING FOR ARRANGEMENTS WITH QUALIFYING
COGENERATION AND SMALL POWER PRODUCTION FACILITIES UNDER SECTION
210 OF THE PUBLIC UTILITY REGULATORY POLICIES ACT OF 1978.
WHEREAS, certain obligations are imposed on nonregulated electric
utilities by Section 210 of the Public Utility Regulatory
Policies Act of 1978 (PURPA) and regulations promulgated
thereunder by the Federal Energy Regulatory Commission ("FERC");
and
WHEREAS, the City of College Station's electric utility operation
is a nonregulated electric utility within the meaning of the
above statute and regulations; and
WHEREAS, the City of College Station is required to comply with
18 CFR Section 292.401(c); and
WHEREAS, the City of College Station is required by the FERC's
regulations, 18 CFR Section 292.401(c), to file a report
describing the manner in which the City will implement Subpart C
of 18 CFR Part 292;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS:
SECTION 1: The City of College Station hereby undertakes to
comply with all lawful regulations of the FERC codified in
Subpart C of 18 CFR Part 292 dealing with arrangements with
qualifying cogeneration and small power production facilities
under Section 210 of PURPA.
SECTION 2: The City Attorney is hereby authorized and directed
to file with the FERC a copy of this Ordinance reflecting the
City's compliance with 18 CFR Section 292.401(c).
SECTION 3: The City Secretary is hereby directed to certify the
passage of this Ordinance by publishing the same or causing the
same to be published in the Bryan/College Station Ea~le.
Additionally, the City Clerk is directed to post a notice of this
Ordinance on any and all public bulletin boards where official
notice of the City Council's activities are normally posted.
