AN ORDINANCE AMENDING CHAPTER 3, SECTION 109.5 OF THE BUILDING
CODE OF THE CITY OF COLLEGE STATION, TEXAS, RELATING TO UTILITY
DEPOSIT REQUIREMENTS, AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS:
That Chapter 3, Section 109.5 of the Building Code of the City of
College Station, Texas, is hereby amended to read as follows:
CO}~ERCIAL AND INDUSTRIAL CONSUMERS
(1) Tem~orar~ Turn-on
On and after the effective date of this section, an
application for temporary turn-on of electricity and/or
water service for use in connection with any business
establishment or commercial enterprise, may be granted
upon application for a Certificate of Temporary Utility
Turn-on.
(2) Temporary Turn-on Fee
There will be a fee of $100.00 for temporary turn-on for
a period of fifteen (15) days and any extension thereof
will be available for a fee of $100.00.
(3) Termination of Tem~orar~ Turn-on
The City shall have the right to deny temporary utility
turn-on when there is violation of the Building Code on
the premises. The City shall have the right to remove
the meter and terminate utility service upon the
violation of any condition of the permit and the
occupant of the building shall be entitled to receive
thirty (30) minutes verbal notice of the intent to
remove the meter. No other notice is required. In such
event, the City shall have the right to terminate
utilities to the location until all conditions of the
final Certificate of Occupancy are complied with.
Further, the City shall have the right to remove the
meter and terminate utilities at the expiration of the
fifteen (15) day temporary utility turn-on certificate.
The contractor and/or owner shall be required to hold
the City of College Station harmless against any claim
as to the termination of utility service by a City
official or employee, and the execution of a written
agreement for this purpose shall be required.
