HomeMy WebLinkAbout12-12-85-13 - Resolution - 12/12/1985RESOLUTION NO. 12-12-85-13 WHEREAS, the Brazos Valley Community Action Agency, herein- after referred to as "Agency", receives USDA donated commo- dities; WHEREAS, one of the purposes of the Agency is the distribu- tion of food and the Agency regularly distributes food to eligible individuals in the Brazos Valley area; and WHEREAS, the City of College Station has found the Emergency Food Assistance Program to be beneficial to be residents of the City of College Station; NOW, THEREFORE, BE IT RESOLVED BY THE City Council of the City of College Station that the Mayor is hereby authorized to sign the attached agreement in order that the Brazos Valley Community Action Agency may provide the residents of the City of College Station with services under the Emergency Food Assistance Program. PASSED and APPROVED this 12th day of December, 1985. ATTEST: City S~c~tary STATE OF TEXAS COUNTY OF BRAZOS The Brazos Valley Community Action Agency, hereinafter referred to as the Agency, and City of ColleEe Station herein- after referred to as the Contractor hereby make and enter into this agreement for services under the Emergency Food Assistance Program. The Parties agree as follows: The Contractor: A. The Contractor agrees to distribute Title II commodities to individuals in the following city(s) City of ColleK ~tation · Be Ce De Fw Ge The Contractor agrees that commodities received under this contract shall be used for distribution to eligible individuals as defined by the Texas Department of Human Resources (TDHR), in such amounts as authorized by TDHR. The Contractor agrees that commodities received under this contract will only be used for the purposes specified and will not be sold, traded, or otherwise disposed of without prior approval of the Agency. The Contractor agrees that commodities will be made available to all eligible individuals regardless of race, color, national origin, sex, age, or handicapping conditions. The Contractor agrees that no payments, no donations, no materials or services shall be required or accepted from eligible individual under any circumstances. The Contractor agrees that membership in a specific organization, atten- dance at the meeting of a specific organization, or membership dues shall not be required of applicants for emergency food. The Contractor agrees to publicize the date, time and location of commo- dities distributions. The Contractor will not issue any foods that are in questionable condition and will immediately call the local health agency for an inspection of the food. Health agency instructions will be followed. The Contractor will report the findings to the Agency. The Contractor will complete all required forms in an accurate manner. The Contractor will forward all forms to the Agency following each distribution. The Contractor will be responsible for any improper distribution or use of commodities, including loss of, or damage to, commodities caused by fault or negligence. ne Any commodities remaining on hand after the ending date of this contract or upon termination of this contract will be disposed of in accordance with instructions from the Agency. The Agency: A. The Agency agrees to provide USDA-donated commodities in amounts it deems appropriate for distribution. B. The Agency agrees to provide guidance on the receipt and storage of commodities. C. The Agency agrees to provide application/eligibility determination/ distribution forms, income eligibility and distribution guidelines. D. The Agency agrees to provide technical assistance or guidance upon request. II This contract may be cancelled by mutual consent; however if such mutual consent cannot be attained, then and in that event, either party to this contract may consider it to be cancelled without cause by the giving of thirty (30) days notice in writing to the other party and this contract shall thereupon be cancelled upon the expiration of such thirty (30) day period.
