A RESOLUTION IN OPPOSITION TO HOUSE BILLS NUMBER
315, 316, and 317.
WHEREAS, the City Council of the City of College
Station has reviewed and heard evidence with re-
gard to proposed legislation on House Bills Number
315, 316, and 317;
WHEREAS, the City Council found that the House
Bill No. 315 which would require municipalities
owning their own utilities to defend their rates
before the Public Utility Commission to be expen-
sive to the individual ratepayers and without suf-
ficient justification since the individual rate-
payer has control of the rates through the elec-
tion process by virtue of the City Council setting
rates;
WHEREAS, the review process that would be created
by House Bill No. 315 places an increased finan-
cial burden upon municipalities and their rate-
payers by virtue of the attorney's fees and engi-
neering fees generated by rate cases;
WHEREAS, the City Council found that House Bill
No. 316 created a burden upon municipal ratepayers
since it is an attempt to force equality between
ratepayers in cities and those outside of cities,
even though the ratepayers residing outside of
cities do not pay taxes in support of utility sys-
tems;
WHEREAS, the review process that would be created
by House Bill No. 316 places an increased finan-
cial burden on municipalities and their ratepayers
by virtue of the attorney's fees and engineering
fees generated by rate cases;
WHEREAS, the City Council found that House Bill
No. 317 places unreasonable burdens upon community
decision-making, in that, in some cases it usurps
community decision-making in that it allows the
Public Utility Commission to second guess communi-
ty decisions with regard to the creation of gen-
eration and transmission facilities;
WHEREAS, the review process that would be created
by House Bill No. 317 places a financial burden on
municipalities with increased attorney's and engi-
neering fees;
NOW, THEREFORE, BE IT RESOLVED that the City Coun-

~(~I{!. to the defeat of this proposed legislation.
