WHEREAS, CITY and CSISD understand that CSISD is scheduled to open an athletic complex on the property described in the at- tached Exhibit "A" (hereinafter referred to as "Property"); WHEREAS, CITY requires either the completion of public in- frastructure or security for the completion of public infrastruc- ture prior to the filing of a final plat and issuance of a build- ing permit; WHEREAS, CSISD must plat the Property to identify the loca- tion of all public infrastructure that the CITY will accept for maintenance where the proposed athletic complex will be located; WHEREAS, CSISD has agreed to and is required to provide easements around all existing and proposed public utilities; WHEREAS, CSISD has indicated its desire to initiate con- struction under the site plan while at the same time going through the platting process. NOW, THEREFORE, in consideration of the recitations above and the promises contained herein, the parties agree as follows: 1. CITY will issue a building permit to CSISD for construc- tion of the proposed athletic complex based upon the site plan approved by CITY on November 3, 1988. 2. CSISD will initiate platting of the Property contempora- neously with the issuance of the building permit. The parties understand and agree that CSISD will not receive a Certificate of Occupancy as defined by the City Building Code until the final plat has been filed for record.
