C.ouncilman Gar .c~. er referred to page two of the workshop meeting
minutes, agenda item no. 3, second paragraph. He changed the sentence
to read: "He also commented that ZBA cBscussed variance requests for
the interior islands in commercial parking lots."
Councilman C~ardner moved approval of the world, hop meeting minutes as
corrected, and approval of the regular meeting minutes as presented.
The motion was seconded by Councilman Mcilhaney which carried
unanimously, 7-0.

Associates for the installation of monitonn¢[ wells and water quality
samplinq and analysis at the Rock Prairie Road Landfill.
Councilman Birdwell indicated that the city had existingmo_nitoring wells.
Mark S.mi.'th, Assist..ant. Publlc Services Director replied that this request is
for additional monitonng wells in the new area of the land,Il.
Counc. ilman Crouch moved approval of the contract with R.W. Harden &
Assocmtes. The motion was seconded by Councilman Schneider which
carried unanimously, 7-0.

diseases and they may need to be treated the same as dogs and cats

Dr. Bruce Lawhorn addressed the Council. He stated that he will be glad
to work with staff in regards to certain vaccinations for these particular
pigs.
Ms. Della Carroll came forward to show her small potbellied pig to the
council.
Mayor Ringer closed the public hearing.
_Agen_da Item No. 3 - Co~eration of an ordinance amending Chapter
Section 1 of the Code relating to animal control.
Councilman Schneider moved to. approve Ordinance No. 187~.. The
motion was seconded by Councilman Brown.
Councilman Crouch moved to amend the motion by adding an effective
date of February 1, 1991.

Councilman Mcllhaney seconded the motion which carried unanimously,

Dire.ctor.of Public Se. trices Joe .L. aBeaupresented this item. He pointed
put that ut May of th~s year ~e ti]~,ping fee was lowered at the landfill from
$18.00/ton to $15.00/ton. Th~s ordinance would amend the roll-off service
charae to commercial and r.esidential custome~ from $18.00/ton to
$1§.00/ton He added that th~s amendment also utcludes an unprepared
waste charge of $50.00.
Cou.ncilm. an Birdwell suggested asking the agency to r~-~e their roll-off
serwce charge to $18.00-/ton.
Mr. LaBeau ~remarked that he ~ unaware of any revenue deficiencv with
the current $15.00 rate. Councilman Birdwell pointed out that $18.00/ton
was projected at the time the land,II was consolidated.
Mr. LaBeau replied that he will look into Mr. Birdwell's suggestion and
respond with accurate information.

Mayor Rinaer stated that the passage of this resolution will allow.the city
to l~e competitive with other persons in the. roll-off cont .airier serwce. No
further action would be required by council if the rate cltanges.
Councilman Brown moved approval of the resolu~on as p. resented. The
motion was seconded by Cou. ncilman Crouch which carned by a vote of
6-1, Councilman Birdwell against.
Councilman Birdwell moved to direct st~ to ask BVSWMA to consider
r~,ina the ti pin~ fee to $18.00/ton Mr Ragland replied that_ an~,.

Planning Director Callaway presented this item. He noted that ~is item

He explatned the proposed changes.
Councilman Birdwell asked, if the council held ,~cussio.n. regarding the
police placing citations_ on illegally parked cars. Councilman .B. rown.
responded by stating that this was discussed; however, council felt the
police should be more attentive to serious crimes such as burglarie.%
stolen vehicles, etc. Mr. Callaway explained that the. amendment will.
all.ow the city to have a c. itation enforcement mechanism whether it is ~y
police officers or other city personnel.
Mayor Ringer asked if anyone in the audience would like to speak. No
one came forward.
Councilman Grouch moved to approve Ordinance No. 1873. The motion
was seconded by Councilman Brown which carried unanimously, 7-0.
oA~ect~ Item No. 6 - Consideration of an ordinance amending Chapter 10
Code to add a school zone in the vicinity of the new _Jr. Hlah
School on Rock Prairie Road.
Councilman Birdwell moved approval of Ordinance No. 1874.. The motion
was seconded by Councilman McIlhaney which carried unanunously, 7-0.

Personnel Director Karen Pavlinski addressed the Council. She stated
this ordinance is considered by the .cguncfl annually; i_t ~)~ows the city_ to
use the most current year in deterrmnmg the benefits for re~ement of

She added that there is no additiona~ expense xor uus nenefit.
Councilman Birdwell moved approval of Ordinance N.o. 1875.. The motion
was seconded by Councilman McIlhaney which carned unannuously, 7-0.

Senior Planner Jane Kee explained this item. She stated that this item was
d~-~cussed at the workshop session. She summarized the proposed
ordinance amendment.
Councilman Crouch suggested ref-~.'.mg the points credited for new canopy
trees to 280 from 200. Ms. Kee replied that 200 was .the best _balance
between matching the cost differential; and yet, receive an adequate
number of trees. -Ms. Nee stated that she will be glad t.o look at the
option of giving more points for large trees on larger sites. She added
that there are several large projects at this time waiting for the outcome of
this amendment.
Councilman Schneider commented that he hoped .the decorative .pavers
will not be a standard for les.s trees. Ms. Kee replied that the or~nanc_e
does n_ot alter the po~t requirement or the tree n. umber requirement. It
states that in certain ~slands you re_ay place specialty pavers, but you must
put the same number of trees on the site.
Co. uncilman Schneider urged, staff to explore the issue of irrigation as
being part of the regulations m the future.
Mayor Ringer asked staff to also look into "xeriscaping".
Mayor Ringer opened the public hearing.

Agenda Item No. 9 - Consideration of an ordinance for the shove item.
Councilman Brown moved to approve Ord~aance No. 1876. The motion
was seconded by Councilman Schneider.

Councilman Birdwell moved to amend the motio.n by adding a 10. percent
point credit for locations where automatic irrigation systems are installed
and applied on_ly to landscaping that is provided. The amended motion
was seconded by Councilman Schneider.
C..o. uncilman.McIlhan, ey stated that she would like staff.to look at the
different options available before such an amendment ~s adopted.
Councilman Garchuer asked for clarification. Mr. Birdwell stated that this
amendment pertains to areas that are landscaped.
Ms...Kee stated that the st~ has looked at 10 percent .a~..d 20 p. ercent
credits. She added that staff would prefer that the credit be gtven fo_r
sites that are 100% irrigated. She also preferred the 10 percent credit.
Councilman Birdwell restated his motion to read that the owner receive a
10 percent credit on total required points where an automatic irrigation
system is provided for the entire site.
The amendment to the origi_n___al motion carried by a vote of 4-3.

AGAINST: Councilmen Brown, McIlhaney, Crouch
The .motion to approve Ordinance No. 1876 as amended carried

Councilman Crouch moved to approve a $430.00 per.month increase over
lastyear's s_alary for the City Manager and a $~.65.00 increase per month
for the City Attorney.
Councilman Birdwell commented that the timing for taking such action is
inappropriate.
Councilman Schneider seconded the motion which carried by a vote of
§-9., Councilman Birdwell and Gardner voting against.
