Brandon Heighis for landscaping on Rock Prame Road.
He asked fi.the city pro, des water to these property.owners. Asst. City Attorney
Coates replied that he will get him an answer. Mr. B]rdwell questioned the
provision in the agreement relating to attorney's fees.
Councilman Gardner inquired about the nature of landscape. Mr. Coates
remarked that the landscaping will be placed between the sidewalk and the lot.
Mr. Gardner asked if there is anything the city can do if the .h. omeowner's
association does not maintain the properS.. Mr. Coates replied that there are
provisions in the contract that allow the cxty to remove the landscaping if the
homeowner's association does not continue maintenance.
Councilman Mc][lhane.~, asked if the staff can develop .a. greements with the other
homeowner's associaUons in the city. Mr. Brymer replied that it is possible to
work with other associations if they volunteer.
Mayor Ringer suggested that staff contact other homeowner's association
members.
Councilman Schneider expressed concern about the landscaping between the
sidewalk and curb because it is unsightly.
City Manager Ragland pointed out that the staff has been researching the
dr~nage issue and the community appearance issue and will bring a
presentation to the council at a later meeting.

Mr. Coates stated that water is being supplied by Myrad to the property.
Agenda Item No. 2 - Consideration of a policy hnplementing a franchise
_am'eement ~tion fee.
Asst. City Attorney Bailey-Graham presented this item. She stated that the staff
proposes a policy to implement a franchise agreement preparation fee for
demand driven service.
Ms. Graham explained that the council previously grante.d franc.l~s, es to .Doux
Chene Apartments and Pebble Creek, yet they .f. alle.d to sign then' franchises
within the 60 clay period. Staff proposes a solution m each of these cases, and
that is to extend the period to 120 days allowing more time to obtain their
signatures.
Mayor Ringer suggested adding to the letter of acceptance the statement, "that
failure to execute this acceptance by (date), the franchise will become void."
Ms. Graham also explained that many staff hours are involved in preparing the
franchise agreements. The fee will benefit the staff in two way?. One, it will
help ensure the city that the applicants are serious ab.o. ut obtaining the fran.chise,
and secondly, the staff can recover the cost for providing this demand service.
The council agreed that the staff should continue to develop a policy to
implement a reasonable franchise fee.
_Aaen_ da Item No. 3 - Presentation of ordinances rec~ula~ the develom~tent of
Asst. Public Services Director Mark Smith addressed this item. He stated that
there are two ordinances that impact the development and operation of recycling
drop-off centers, the sanitation ordinance and the zoning ordinance.
Jim Callaway addressed the Zoning ordinance amendment to add a section
relating to recycling facilities. The purpose of this section is to establish
development standards for large and small recycling facilities. He presented the
zoning districts that allow recycling facilities.
Mark Smith addressed the proposed amendment to the sanitation ordinance.
Included in the ordinance amendment is a section for record keeping
requirements.
Councilman Birdwell suggested that the ordinance amendment contain a
provision for temporary permits to prevent overflow, accumulation, etc. He
asked about the type of insurance required and questioned the requirement of
providing a sales tax number on the application.
The council concurred that the staff should continue to pursue this.

~ Item No. 4 - Discussion of Council Relations Policy_.
Councilman McIlhaney stated that she made the revisions to the policy
discussed at the last council meeting. Also attached to the policy were revisions
to the Code of Ethics by Councilman Crouch. Councilman Gardner stated that
he also has suggested changes to the policy.
After further discussion, the council agreed that this item be .p. laced on the next
council agenda for consideration. Additionally, ff any Councilman has further
suggestions to the policy, please submit them in writing.
Age~da Item No. 5 - Council Concerns.
Councilman Birdwell provided an article to each Councilman from the Houston
Post newspaper regarding Amtrak's propo, sal to charge $120,000 to the operation
of the Amtrak station for the excursion tram that travels from Galveston to
Houston.
Councilman Crouch referred to the article in the Texas Town and City magazine
entitled "Who'll Stop the Rain." The City of Euless is charging citizens for
drainage service which is included as a service charge on the utility bill.
Councilman Schneider mentioned that he was glad to see the article in the
newspaper regarding TAMU's mission statement.
