AN ORDINANCE AGREEING TO PARTICIPATION BY THE CITY OF COLLEGE
STATION WITH AREA PROGRESS CORPORATION IN THE CONSTRUCTION OF
BIRMINGHAM DRIVE.
WHEREAS, the City of College Station Is seeking additional access
to its Utility Service Center;
WHEREAS, the construction of Birmingham Drive will provide the
needed access to the Utility Service Center from Southwood Val-
ley.
WHEREAS, Area Progress Corporation will construct a street
thrlty-nlne (39) feet in width and an eight (8) inch waterline
and dedicate to the City of College Station right-of-way
sixty (60) feet wide by one thousand three hundred and forty-four
(1344) feet long from Belmont Place Section One to the Utility
Service Center;
WHEREAS, the City's participation cost will not exceed thirty
percent (30%) of the total construction cost of Birmingham
Drive; and
WHEREAS, upon completzon of the construction of Birmingham Drive,
Area Progress Corporation shall dedicate Birmingham Drlve from
Belmont Place Section One to the Utility Service Center~
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION:
That the Clty of College Station will part~cipate ~n the
construction of Birmingham Drive from Belmont Place Section One
to the Clty's Utlllty Service Center subject to the following:
1. Clty's cost partlcipat~on will not exceed thirty percent
(30%) of the construction cost of Bxrmingham Drive from Belmont
Place Sectlon One to the Utility Service Center.
2. Area Progress Corporation shall provide a performance
bond executed by corporate surety pursuant to Article 5160, Texas
Revxsed Civil Statutes for the construction of the improvements.

3. Clty's payment shall become due and payable upon
completion and dedication of the road as specified.
