AN ORDINANCE VACATING AND ABANDONING A BLANKET UTILITY EASEMENT
IN THE D. A. SMITH ADDITION, RICHARD CARTER LEAGUE, ABSTRACT 8,
COLLEGE STATION, BRAZOS COUNTY, TEXAS, FOR AND IN CONSIDERATION
OF A PERMANENT ELECTRIC UTILITY EASEMENT EXECUTED ON SAID TRACT
OF LAND.
WHEREAS, the LaQuinta Motor Inn having requested that a blanket
utility easement on part of Lots 24, 25, 29 and 30 of the D.A.
Smith Addition and Lot B of a vacating and resubdivision of a
portion of Lot 26 and Lot 31, D.A. Smith Addition, Richard Carter
League, Abstract No. 8, in College Station, as recorded in the
Deed Records of Brazos County, Texas, in Volume 98, Page 225, be
abandoned, and the City Council having heard the request of the
said property owner;
WHEREAS, for and in consideration of the abandonment thereof, the
City Council requested that a permanent electric utility easement
be executed on said tract for the "as built" electric lines as
shown in the attached Exhibits "A", "B", and "C".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS:
That a temporary blanket utility easement on part of Lots 24, 25,
29 and 30 of the D.A. Smith Addition and Lot B of a vacating and
resubdivision of a portion of Lot 26 and Lot 31, D.A. Smith Addi-
tion, Richard Carter League, Abstract No. 8, in College Station,
as recorded in the Deed Records of Brazos County, Texas, is
hereby abandoned upon the execution of a permanent electric
utility easement for the "as built" electric lines upon the
above-described property as shown in the attached Exhibits "A",
"B", and "C". The Mayor is hereby authorized to hold the
ordinance and execute it and a quit-claim deed to the property
encumbered by the temporary blanket easement upon the acceptance
by the City Attorney of a permanent electric utility easement for
the "as built" electric lines on the above-described property.

League, Abstract No. 8, Hrazos County, Texas, and being comprised of a
portion of Lots 24,25, 29 and 30 of the ~A. Smith Addition, as shown by plat
recorded in VOLUME 49, PAGE 106, of the Deed Records of Brazos County,
Texas, said 0.16 acre (6918 square foot) tract being also a portion of the
following three tracts:
1) A 14299 square foot tract conveyed from N.D. Durst and Henry B. Clay
to La Quints Motor Inns, Inc., as described by deed recorded in VOLUHE 369,
PAGE 136, of the Deed Records of Brazos County, Texas.
2) A 7382 square foot tract conveyed from Omar Smith Enterprises, Inc.,
to La Quints Motor Inns, Inc., as described by deed recorded in VOLUME 388,
PAOE 239, of the Deed Records of Brazos County, Texas.
3) A 101427 square foot tract conveyed from Norman Beal, et al, to La
Quints Motor Inns, Inc., as described by deed recorded in VOLUME 388, PAGE
235, of the Deed Records of Brazos County, Texas.
Said 0.16 acre (6918 square foot) tract being more particularly
described as follows;
COMMENCING at a 1/2" iron rod found marking the south corner of said
7382 square foot tract, said corner being also the intersection of the
northeast right-of-way line of Texas Avenue and the northwest right-of-way
line of Live Oak Street.
THENCE N 45° 06' 03" W for a distance of 202.50 feet with said Texas
Avenue right-of-way line to a 1/2" iron rod found for corner.
THENCE N 42° 48' 07" E for a distance of 27.02 feet with the northwest
line of said 14299 square foot tract to a point for the PLACE OF BEGINNING.
THENCE N 42° 48' 07" E for a distance of 568.98 feet with the northwest
