HomeMy WebLinkAbout1986-1683 - Ordinance - 10/09/1986ORDINANCE NO. 1683 AN ORDINANCE VACATING AND APANDONING A PORTION OF A SANITARY SEWER EASEMENT LOCATED ON LOT 23, BLOCK 3 OF SOUTHWOOD SECTION SIX, COLLEGE STATION, BRAZOS COUNTY, TEXAS, BEING A 14.7 SOUARE FOOT PORTION, AND BEING MORE PARTICULARLY DESCRIBED ON THE ATTACHED EXHIBIT "A", FOR AND IN CONSIDERATION OF A FIFTEEN FOOT (]5') SANITARY SEWER EASEMENT EXECUTED AS DESCRIBED ON THE ATTACHED EXHIBIT "H". WHEREAS, C. L. and Janice Ptaszek filed an application and request with the City Council of the City of College Station that a 14.7 sauare foot portion of a sanitary sewer easement located on Lot 23, Block 3, of Southwood Section Six, in the City of College Station be vacated, and the City Council having heard the request of C. L. and Janice Ptaszek; WHEREAS, for and in consideration of the vacating thereof, the City Council requested that a fifteen foot (15') sanitary sewer easement running parallel to the City right-of-way along Nueces and Arboles Streets be granted bv c. L. and Janice PtaszeW to the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: Pursuant to an application and request filed with the City of College Station, Texas that a portion of a sanitary sewer ease- ment located at 1823 Nueces, described in the attached Exhibit "A", be abandoned and vacated upon execution of the sanitary sewer easement described herein in Exhibit "B", the Mayor is hereby authorized to hold the ordinance and execute it upon acceptance by the City Attorney of a sanitary sewer easement as described herein, and the Mayor and City Secretary is authorized to convey by Quit Claim Deed on behalf of the City of College Station any right or claim which the City has in and to that portion of said land descrIbed in Exhibit "A". PASSED, ADOPTED and APPROVED this 9th day of October, 1986. GRANTEE. AND ITS SUCCES- SORS AND ASSIGNS, TO CONSTRUCT, ERECT. BUILD. EQUIP. OWN. MAINTAIN AND OPERATE IN. ALONG. UNDER. OVER AND ACROSS THE STREETS. AVENUES, ALLEYS, BRIDGES, VIADUCTS AND PUBLIC GROUNDS OF THE CITY OF COLLEGE STATION, TEXAS SUCH POSTS. POLES, WIRES, CABLES. CONDUITS AND OTHER APPLIANCES. STRUCTURES AND FIXTURES NECESSARY OR CON- VENIENT FOR RENDITION OF TELEPHONE AND OTHER COMMUNICATION SERVICE AND FOR CONDUCTING A GENERAL, LOCAL AND LONG-DISTANCE TELEPHONE BUSINESS; PROVIDING FOR CONSIDERATION: FOR PERIOD OF GI~%NT: FOR ASSIGNMENT; FOR METHOD OF ACCEPTANCE FOR REPEAL OF CONFLICTING ORDINANCES; AND FOR PARTIAL INVALIDITY." and WHEREAS, said Ordinance was on the 23rd day of October, 1986, duly approved by the Mayor of said City and the seal of said City was thereto affixed and attested by the City Secretary: NOW THEREFORE, in compliance with the terms of said Ordinance as enacted, approved and attested, General Telephone Company of the Southwest hereby accepts said Ordinance and files this its written acceptance with the City Secretary of the City of College Station, Texas in his office.
